Permanent Residence

Hello,

I currently hold Unlimited Single Permit and is valid till 8.8.2024. Next year i will get it renewed anyways.

Also, In JulY i will complete 5 years in belgium. I went to commune today and they told me that i can not apply for PR myself. I keep on renewing my existing Unlimited SP until Brussels decide to give me PR(Type B). I don't think this is correct process. Can someone please guide me? Why commune is saying that i can not apply for PR myself?

I believe for the B card that is correct, but I think if you go for the L card you can apply for yourself. Someone correct me if I’m wrong though! You can find info on these on ibz.be

At which commune you applied ? And you are living in same commune for 5 years?

yashuu1991

applied in Mol. No i was living in Geel for 3 years and 2 years in Mol..  but living in 2 different commune does not effect PR as per officials. They are saying we can not apply even if i stay for 5 years in same commune.. there is no such process..

@sivadanamreddykumar I’m in Vlaanderen, Antwerpen to be specific. I have only been here for a month and actually still waiting on my first single permit, but I've done quite a bit of research on this because I do want to get nationality as soon as I qualify. You can also try searching the forum on here, I believe there have been others asking similar questions

In July next year you can apply for L card (After completing 5 yers) then you can apply for the renewal of your A card. B card is issued by the foreigner office upon the renewal of your A card, you cannot ask for it.

If you have two ongoing requests of L and a renewal of A card after 5 year, you will be granted L card.

@yashuu1991 Hi,

A few questions before we can guide you properly.

Unlimited SP ? --> You currently hold an A card right?

Employment --> When you plan to apply for your PR, Would you be on a local employment contract for the past 5 years?

PR --> Why do you want to go for a B card. This card is under the discretion of Brussels. Go for an L card where you have the opportunity to be employed easily across Europe. This is normally provided in 5 months time.

Yes i have A card which is not linked to employer anymore. there is process in flander to convert A card and unlink with specific employer. I got it last week.

Yes i am on local contact since April 2019 but i got my card on July 2nd so i will be eligible for PR/ LCard from July itself.

I just applied for an L card today, but I have an unlimited A-card that expires in May.

If you apply for the A-card after 5 years in Belgium while the L card is pending, do they give you another A card in the interim before the L card is approved?

Also, at the commune they mentioned that I would have to go through the single permit process to renew may A card, however, when I got home I checked the Annexe 46 I received when I got the unlimited A card and it says the following:

"La demande de renouvellement du permis unique est introduite par le travailleur auprès de l'autorité communale compétente (art. 61/25-6§5 de la loi du 15/12/1980). La demande de renouvellement comprend un contrat de travail valable, la preuve récente de moyens de subsistance suffisants, la preuve d'une assurance maladie valable et la décision de la Région qu'il a été admis à travailler pour une durée indéterminée."

My understanding is that I just have to go to the commune with the documents listed to request a new A card. Do you know if this is correct?
