Belgian Nationality - Police check

Muhammad Hanif69

@ABS25 thats great i heard.i have F card 5 years.i did A2 Level Nederlands + integration course + 4 years self employed work.i seeing my birth certificate since 5.01.2023..

ABS25

@Muhammad Hanif69 Another sign of approvement of your nationality is that your card will be blocked and you will not be able to sign in on mon dossier and this will happen after around 4 months and one week or few more days. Then you will receive invitation from the commune to apply for Belgian eID.

ABS25

@Muhammad Hanif69 Also remember if you are living in a bigger city for example antwerp etc, it may take more time than 4 months and one week in your case to get invitation from your commune

ABS25

@Muhammad Hanif69 Did you have a police interview?

Muhammad Hanif69

@ABS25 i am living in Brussels but in  my commune Citizenship process time 4 month 4 days..my many friends got their citizenship in the same process..but your right 4 months 4 days after they just give you decision but the invitation letter arrive after 10 days..

Muhammad Hanif69

@ABS25 here in Brussels police not come home.just apply in Commune and wait 4 months 4 days..i hope mine will be positive.my f card will expire on 5 june 2023 but i do not recieve invitation for renewal also.my wife recieve the invitation to renew card 3 months before the expiary..

Muhammad Hanif69

@ABS25 thats good information.so you mean when the 4 months 4 days complete my will block?not before 4 months..great information.

ABS25

@Muhammad Hanif69 Yes when this timeline passes or around this timeline before or after 4 months period, your card F will be blocked/cancelled and you will not be able to login on mon dossier and other websites. This is the final and 100% prove that your nationality has been approved. After all this, you will receive an invitation from the commune.

ABS25

@Muhammad Hanif69 Actually this timeline is 4 months and 1 week but in some cases its 3 months. In some cases its 4 months and 2 weeks, it depends.

Muhammad Hanif69

@ABS25 thank you for giving me plenty of information about it...some people says that if i do not have any letter or refusal with 45 day,2 months or max 3 months so you should be positive.but with your answer i hope 100% mine Citizenship application will positive.

ARMaliq

@Muhammad Hanif69 Hello, I have a question. Can you tell me if you had your birth certificate freshly attested by Ministry of foreign affairs and Legalized by BE embassy or it does not matter when you have done it?

vocicag725

@ABS25 hello,

i see the last update date on mon dossier is date when i got my PR. I applied mid December so not sure if you have an idea if thats normal?

ABS25

@vocicag725 When did you get PR? The date i mean and You applied for nationality in mid december?

vocicag725

@ABS25 i took out my PR card in Nov - and applied for the citizenship in Dec. so the date of the last updated is the date of Nov.

Muhammad Hanif69

@ARMaliq i think it does not matter if you have already legalized by Be embassy in your country.but you can ask in Commune because i submit fresh Birth certificate because i do not have it before.

ABS25

@vocicag725 And which commune is it? I mean a larger one or a smaller one? Was your nationality dossier stronger? Which pathway you took to apply for nationality?

vocicag725

@ABS25 Brussels commune so its a big one.

i applied through acquiring (Working days/Integration/Language). Received same day a confirmation that within one week my file will be forwarded to the Prosecutor's office.

No communications since.

Muhammad Hanif69

@vocicag725 when you applied Nationality?

ABS25

@vocicag725 Which kind of accuse de reception you received? It was mentioned on that accuse de reception that your file has been forware to parquet?

vocicag725

@Muhammad Hanif69 mid December it was.

vocicag725

@ABS25 it was mentioned that the civil servant has one week to forward the file to the prosecutor’s office and the file has been completed with all the required docs.

ABS25

@vocicag725 There is a possibility that your file was not transferred to prosecutor. Did you check again with commune during these 3 months?

vocicag725

@ABS25 no not yet .. i guess i can send an email to check. Not sure of the correct procedure.

Muhammad Hanif69

@vocicag725 normally in Brussels they gave you time 4 months 4 days.if you try to ask them before the deadline they will not respond you.you have to wait.you log in commune website and check your certificate that they generate your birth certificate or not?

vocicag725

@Muhammad Hanif69 oh okay. I guess i have to wait and see then.

not sure what happens if my file wasn’t forwarded to the prosecutor’s office?

I dont see my birth certificate on mon dossier but i gave it to them when i submitted my file.

ABS25

@vocicag725 In my opinion and what i know from some lawyers, there are only 2 possibilities regarding accuse de reception:

  1. Commune takes 30 working days to check your file and in this case you receive 2 accuse de receptions. In this case, the timeline is 30 working days+4 months and 1 week.
  2. Commune issues you accuse de reception immediately on the same day of signing the declaration and on same day your file is transferred to prosecutor. In this case official timeline is 4 months and 1 week.

Now i think you should check with the commune if they forwarded your file or not. If they do not respond, and you do not see any updates on your file on mon dossier even after 3.5 months, then i think its 60/40. You might face a refusal. I am sorry but it seems like this. But still keep fingers crossed.

ABS25

@vocicag725 But remember again, if you think your file was strong enough and there was nothing lacking, then you should be confident to receive a positive answer. They follow law strictly for nationality cases.

vocicag725

@ABS25 i’m the second point. i got the confirmation same day that my file will be forwarded in one week.

i’m still within the time frame of the 4 months declared in the paper i got from the commune, so maybe thats why mon dossier got nothing to be updated with as its still no decision issued.

Lets see. Thanks

vocicag725

@ABS25 yes i have everything was asked of working days, integration, language .. etc.

what worries me now is that the file not being forwarded to the prosecutors.

but at the same time the receipt confirms that the file will be forwarded in one week. Fingers crossed indeed

ABS25

@vocicag725 In Belgium, this information is available online, it is always mentioned on accuse de reception that your file is forwarded today to the prosecutor. Meaning that when they forward it, they tell you in written form. They never say it will be forwarded in one week. Its quite strange for me. May be in brussels its like this but not in wallonia and flanders as far as i know.

Muhammad Hanif69

@vocicag725 Normally you have to see Last updated file.when i made a declaration after one month i see my dossie.be last update and also they generate my birth certificate.

At the time i applied they gave me two paper in which they mention your all file verified and forward to Public prosector office.

They gave me 4 months 4 days..

But its better you ask in commune may be they did not forward your file to Prosector office.

ABS25

@vocicag725 Honestly i have seen several cases of nationality by myself, for my family and friends here in Belgium, 4 months and 1 week is official timeline but they always make the decision within 3 months and its sure that you see an update on your mon dossier within these 3 months.

vocicag725

Ok thanks. What kind of update i should see on mon dossier?

if i see that i can download the Belgian certificate?

Muhammad Hanif69

@ABS25 yes Exactly..i know one friend he applied  on 21.12.2022 and he got decission on 13.03.2023.its become 2 months and 20 days.the commune gave him 6 months that your decission  will be with in 6 months.

Same timeline 3 more friends but they in Vlames area but the decision normally pass through Brussels Prosector office.so decision made with in 3 months..Commune also said me if you do not get any letter or we do not ask something more so you think your decision positive.no worry...its in Brussels but small commune.

Muhammad Hanif69

@vocicag725 when you log in my Dossie.be there  you will see my deeds,certificate..

I think click on my deeds and than you will see when you scroll down.at end you will see last updated information..

In this page you will also see your current id card detail..you check also my certificate from registery..

vocicag725

@Muhammad Hanif69 yes thats what the commune said to me that as long as you dont receive letter during the 4 months then you’re fine. No letters received till now.

and that they will email me to come and apply for the I

ABS25

@vocicag725 When you go to your my data page, on the bottom of this page you have two informations,

  1. When was your file created, in french its date de collecte
  2. Last modification, Dernier modification I am talking about this. See the date of dernier modification. Which date is it

ABS25

@Muhammad Hanif69 .

vocicag725

@ABS25 last modification is the date when I received my PR card back in November.

I guess it will be modified when the application is approved or if the prosecutors office didn’t issue a response within 4 months (i read on one of the official websites that issuing no response and passing the waiting period, it actually a positive response)

ABS25

@vocicag725 Then in my opinion, you should contact them if they forwarded your file or not. Yes theoretically if there is no opposition by prosecutor within 4 months, you have a positive answer but technically and practically as Hanif is also saying you should have an update within 3 months.
