Vietnam TRC issues - employer refusing to end TRC

Hi


I live in Bien Hoa in Vietman.  I am having difficulty getting my ex-employer to end my TRC so as that I can gain new employment.  My passport expired in January 2023 and my work permit was valid until June 2023. When I re-newed my passport I think i was ill-advised that I did not need to do anything about my TRC. 


After the Tet Holiday my employer told me that there was no hours for that week; since then he has not given me any hours or reason for this decision.  I have made numerous attempts to ask him to end my TRC and attend the immigration office; he tells me he is too busy to do this.   He is after several months still refusing to end my TRC which is making it impossible for me to seek employment elsewhere.  I have made numerous enquiries with immigration and visa agents all of whom advise that my ex-employer must end the TRC before i can progress.  I am at a loss as to what I should do now to have this rectified.  Any advice would be greatly appreciated.

the advice of others to seek legal assistance is probably good, but I can't help wonder what might have transpired to evoke this attitude from your employer.


if your employer is a dishonest person then this may be an attempt to extort money from you.


but since they haven't asked for anything like that, it sounds as if your employer may have taken offense to something.


unfortunately in situations like that it's not really common for the Vietnamese person to open up and tell you what they find offensive.


I think if I were in your shoes I would consider going to the employer and adopting an extremely humble attitude.


I would make it clear that I realize I must have done something offensive but I'm ignorant because I'm a foreigner so I wish to beg his forgiveness for whatever I have done and maybe ask him to teach me about my conduct in Vietnam.


this might be better to be done through an intermediary, so if you know of Vietnamese person who is close to your employer, perhaps you can approach them and ask them about their perception and also if they would be willing to convey your apologies.


this is just my gut reaction.

Have you given the employer official notice in writing? Once you have given official notice the employer must provide you with a release letter.

Did you sign a contract agreeing to pay them if you leave early?

@cmanganlt hello, I'm a bit confused about the limitations you think you have. 


First you must know that your former employer must revoke your TRC but is also granted to ask for an extended validity up to 6 months for your favor to find a new job. If your employer doesn't mention any extension, you will need an Exit Visa for maximum 15 days.


Also to know:


1) One thing is to work legally, and another is to stay legally. Thus, your Working Permit concerns to DOLISA (Dptm Of Labor) and VISA/TRC concerns to Dptm of Foreign Affairs/Immigration.  (both with the sponsor of your employer)


2) Most institution in Vietnam use to link your passport-book number instead your passport-citizen number. Thus, if you changed your passport-book, the old one is the one granted for visa/trc etc.


3) Nothing in Vietnam denies you to have one or many employers with multiple contracts


So, with the only info you exposed in your post, you can still find another job and receive a new WP. If you are really convinced you couldn't get another TRC, ask to your new employer to be your sponsor for a Visa Type LD2 (1 year)


If you have the "termination of your contract" the office to claim about your TRC is the  Foreing Affairs/Immigration.


If you don't have either your termination nor the contract, you've been pretty careless.

This post is rubbish, your visa, trc, work permit, is only valid with a passport 6 months before expiration. he can't have a trc or work permit after this time.
