Hi Everyone,

I have been with the Chinese company for one year. They called me from Pakistan on their visa and my Iqama is also with this company. They told me to accept the contract on Qiwa which is different from my offer letter. I am an Engineer and the salary difference is also huge.

Now, when I applied for the annual leave, they said that no need to come back as we don't have any further projects yet. They said we will apply the final exit instead of applying for re-entry which is fine with me. But, they are calculating the end of services rewards as per my Qiwa contract. Also, my contract is till June 2024 and If company doesn't have work then according to me they should give me some advance salaries. I have to go at the end of the month but they are neither giving me a final exit nor applying for my re-entry.

Please let me know what can I do. How many advance salaries can I get and if they give me notice period, still I can apply for re-entry and come back at the end of the notice period?

Thanks in advance.

Is it an open contract ( no expiry date) or fixed contract?

if fixed contract they should give you atleast two months salaries or till end of contract, if there is any dispute i would suggest to file a case against them.

Hi Malik, the expiry for the contract is 5th June. I don't think they are planning to give advance salaries so how can I file a case and which articles should I mention?

Please take assistance from google how to file case its really easy you may need to attach your offer letter and contract there would be two outcomes as of my experIence either they have to pay all your salaries till June 24, (  insist to get it according to offer letter) or they must pay you atleast two months salary in advance

court will also provide a translator

Offer letter is NOT legally binding.  Only the contract is.   You should have never signed one with a different salary.
