Lease 2024 Portugal

Capi431

Hi, I signed a lease paid my deposit,  unfortunately in 15 days two months before moving in I had to cancel. The landlord wants to keep my entire deposit even though they found a new tennant 5 days after I had to cancel. Is this legal?

@Capi431 when did the lease started? Usually deposits aren't refundable.

Capi431

@Nia Queiroz it starts April 1, 2024

You could read the legal document you signed/agreed to it's clauses.

Does it say you  can cancel and get your deposit back?

Capi431

@Strontium

it does not say this, it does state if I do not fulfill my lease or do anything damage to the apartment I will not get my deposit back

Capi431

I’m happy to send it to you if that’s possible

It looks like you "did not fulfill your lease" by your act of cancelling so lost your deposit which is what you agreed to.     You could write to the landlord and, politely, briefly explain the circumstances and ask, as an act of goodwill, they refund some of the deposit.
