Termination of rental contract

Some questions related to the rules when a rental contract is terminated. by the landlord (referring to the new ruleset in NRAU):


1) No reason for the termination is given...is this mandatory or optional ?


2) At the expiration date set by the above mentioned termination, I will be 65 years old. This seemingly gives me additional protection , but have been unable to find a  clear description for it...appreciate any  input here!!


Contract was  initiated December 15 2019 with an initial term of three years, after that its on 1 year renewal.

With the NRAU from 2006 (and later additions to that law, such as 2012, 2014 & 2017), the owner of the house has the right to the house through:

...

b) revocation of the contract;

c) expiry of the contract due to the expiry of the term;

d) termination by opposition to renewal;

...


Your case probably falls under case d), so your landlord has this right. After 2006 there are no lifetime tenancies. And the age of 65 only applies to contracts prior to the NRAU, which is not your case.

30 - Em que consiste o procedimento especial de despejo, criado pela Lei n.º 31/2012, de 14 de agosto, alterada pela Lei n.º 79/2014, de 19 de dezembro?


Através da alteração ao NRAU operada pela Lei n.º 31/2012, de 14 de agosto, alterada pela Lei n.º 79/2014, de 19 de dezembro, criou-se um meio processual que se destina a efetivar a cessação do arrendamento, independentemente do fim a que este se destina, quando o arrendatário não desocupe o locado na data prevista na lei ou naquela que resultou do acordo das partes. Este procedimento aplica-se às seguintes situações:


a) resolução do contrato por comunicação, com fundamento no não pagamento de renda, igual ou superior a dois meses, ou por mora superior a oito dias no pagamento da renda, por mais de quatro vezes, seguidas ou interpoladas, no período de 12 meses;

b) revogação;

c) caducidade do contrato por decurso do prazo;

d) cessação por oposição à renovação;

e) cessação por denúncia para habitação do senhorio/filhos, para obras profundas ou, ainda, por livre denúncia (alínea c) do art.º 1101.º do CC);

f) por denúncia do arrendatário.
