Minimum rental duration

Hi,

I signed a rental contract for one year with 60 days of notice period to end my contract. I understand that there's a standard minimum term of one third of the initial duration. So, for my one year contract minimum term would be four months.


However, I'm not sure whether I can give my 60 days notice after two months into my contract, so that my contract ends after four months of rental duration? Or do I need to give my notice of 60 days once four months of rental contract is finished so, I would have to stay for six months in total.

In fixed-term residential leases, the tenant may only leave the home after the expiry of one third (1/3) of the time provided for in the initial term of the lease or its renewal, if any. To do this, the tenant must send a written notice to the landlord notifying him of this intention.

This notice must be given to the landlord as follows:

- at least 90 days in advance for contracts of between 1 and 6 years

- at least 60 days in advance for contracts of 6 months and less than 1 year

- one third of the initial term or renewal term for contracts of less than 6 months.


If your contract is for 1 year, you can leave after 4 months, but you must give 3 months' notice.
