Application for Card B after interrupted work in Belgium

Hello,

I hope I could find a guidance from you in this forum.


In summary,

  1. I came to Belgium July 21, 2020 during the COVID as a trainee until April 2022 (there was no pay slips but they paid me directly to me bank account).
  2. Then I started to work for a year and half until early December 2023, contract ended (I have pay slips for all those months)
  3. I was searching for a job since then and just had one in June 2024 and I received the new ID card-A for this new job only this month of November.
  4. This mean that I did not have a job or pay slips for almost a year.

At the same time, I am a resident in Belgium since July 2020 until now (4 years and 4 months)

I went to the website https://www.socialsecurity.be/ to apply for unlimited work permit. one of the requirement is to send copies of pay slips. I only have pay slips of my previous work that ended last year 2023.

My questions:

  1. Am I eligible to apply?
  2. If I provide the Pay slips of my previous work (19 months) is this enough?
  3. Should I wait for my current job to provide me for few payslips, meaning to wait for 3 or 4 months then to apply?
  4. Should I contact a lawyer for this? I do have financial means to do so but is it guarantee that a lawyer will solve it? or it will be a waste of money with no solution?

You are mixing the two concepts.


A :  B Card(Unlimited residence permit) to able to apply for it you have been lived in Belgium 5 year legally.

(Which you didnt yet.)


B : Unlimited Work Permit :You should have been worked last 4 years and should have valid employment contract to apply for unlimited work permit.

You will be asked 4 years of indivudial rekeningen / compte individual for each year in 4 quarters.

There is the summary of 4 years. If its not full fill the condition, your application will be rejected.

(Which you didnt yet.)


If i were you i would continue with A card 8 months after. (Pay attention to your first period in which status you were lived in Belgium.This is important to count 5 years)

I came to Belgium in a scholarship paid by Belgian government with A-Card since July 21, 2020 and until this moment I have A-Card even with the new job, they only give me A-Card,


Also, based on my residence history in Belgium, it means that by July 20, 2025 the date where I will complete 5 years, I will be eligible for B Card, even with this interruption in work (it will be a total of 27 months of interrupted work + 24 months of Belgian training)?

How to apply? does that go through the commune? thank you very much again.

You must submit your application to the municipality of your place of residence .


Some periods with a right of residence of limited duration only count partially or not at all:


Your stay as a foreign student counts for half. A search year does count fully. Thats why i said Pay Attention.

Your stay for 'exclusively temporary reasons' does not count.
