Immigration case

Post new topic

Mantharali99

Hello Recently I hired lawyer for the my family Reunion visa.  Does anyone have immigration cases knowledge or experience share with me. As per my lawyer throughout his life career 70% cases results came positive.  He will file writ of mandamus. Does we can expect that decision will come in favor of Applicants. My lawyer is very professional authentic responding my all Quires,  I am looking forward to hear from all of you soon.

I work for a company that provides immigration services. Sorry to ask, but what reason did your lawyer give for filing a writ of mandamus instead of going through the administrative process for the family reunion visa application?

@Mantharali99 I have my Brazilian Permanent Residency, but it took a very long time, and I spent six months working with a law firm that said they knew what they were doing, but in the end did not. Finally, a family friend who was a lawyer referred me to another lawyer who helped get it done.

First as @abtree will tell you Immigration lawyers are not common in Brazil, so you may end up with someone who says they know what they are doing, but don't. I agree with @Expatax. A "writ of mandamus" does not make any sense and seems like something that will piss off (pardon my English) the Federal Police.

12/05/24 @Expatax; @roddiesho.  @Mantharali99's case has been going on for a number of years.  In spite of being married to a Brazilian, his visa application based on reunião familiar has been turned down several times by the Brazilian Embassy in Islamabad.  So the issue is with the Ministry of Foreign Affairs, not with the Ministry of Justice/Federal Police.  By his account the lawyer has been engaged by his wife in Brazil and is pursuing has case against the Itamaraty.

@Expatax

My process are in administration process my visa got rejected 3 times

@abthree

Yeah it's a unfortunately.  Trust me visa interviewer officer are so rude. Asking nonsense questions which is not related to visa.  Hopefully lawyer will make it,  because someone pakistan had also same issue he was referred his case same lawyer.  So his decision will come out end of January 2025. Again on 12 December 2024 I have visa interview.  I was applied for the visa that my lawyer can file lawsuit Against embassy.  Because for writ mandamus application should be under 120 day's.  I was also present lawyer contract plus this time my wife is apositile all the documents.  Maybe I get visa before putting case against embassy.

@roddiesho

I agreed the lawyer is very professional and authentic.  Because we know in Brazil it's very difficult find good lawyer.  We have already experienced of this.  If see SUS Immigration or other country if you're family Reunion visa deny or they put you in Administration process. then you have right hire lawyer to file writ of mandamus.  Mostly Immigration cases workout writ of mandamus.  Because if we see it's a legal work.  Once you file writ of mandamus I don't think Ministry of Foreign Affairs or embassy can put themselves in legal trouble.

@Cserebogar

Mike so expensive so we can't afford his services.

Thank you for recommending highly Appreciated.

@Expatax

Basically my visa got rejected 3 times embassy doesn't give me any reason they are returning all documents just expecting visa form & bank Receipt.   For this we hired lawyer to file writ of mandamus,  because if se see SUS US immigration or other countries doing same things when embassy putting thier case in administrative process. Because it's a legal work,  writ of mandamus give order to do it,  because embassy or ministry of foreign affairs must give reason for the denying visa 3 times without any particular reason.
