Work for a UK company from the Netherlands?

Hello,


I am British, my partner is Dutch.


We want to move to the Netherlands.


I work for a British company. I have asked my employer if I can keep my job, and move to the Netherlands (I work from a laptop). They’re all for it.


Is this even possible from the perspective of tax / social security / legalities / etc?


We are really struggling to find any concrete information on this, and now feeling completely deflated.

Hi and welcome to the Forum.


You can do it; many do it, I did it. You just need to decide how you will cope with the red tape and admin.  I didn't consider it and got a nasty surprise when the blue envelope came through my letterbox (ask your partner what that means).


A few points to consider:


  1. where you pay tax is based on where you live for more than 183 days in the tax year relevant to that country (in Holland, unlike the UK, that's Jan > Dec).  There is a tax treaty in place between Holland and the UK, you can download/read them from the UKGov website; this link will take you straight to them.
  2. Holland has 2 types of taxes; income and social, the Dutch Government website tells you all about them and this link will take you to it.  Income taxes are covered in the UK/NL convention, the social taxes are not, you will pay them if you live in the Netherlands.  If you move to the Netherlands, you are deemed a tax resident from day one, so your boss will need to decide how they will pay your Dutch taxes and Medical insurance contributions.
  3. One thing for your boss to consider is your work contract and whether it complies with Dutch/EU law and how will future disputes be settled; also, if you remain on a UK contract, how does the Health and Safety in the Workplace legislation fit in with your Dutch home, what happens if you fall at home and can't work, who will pay your sick pay?


There are agencies in the Netherlands that offer an employment contract and pay service that will make you legally employed in the Netherlands and cover all the bases regarding taxes/medical insurance etc; it's expensive, but if your boss wants to keep you, perhaps they will be willing to pay the fees.  You'll find them on Google.
