Life Partner Permit for South Africa

Hello Guys

I've read a lot about the LPP, but it didn't help me much.

I'm a South African living in Spain and will be going to SA with my girlfriend ( from Chile- she has residency here). It will be in January.

It seems like we would qualify for the -LPP temporary residency-  reading all the blogs and forums about it, but I e-mailed the South African embassy in Madrid and they don't know anything about that. They say it's not a visa that's on the home affairs website.

I told them that it's part of the relative's residency, but they seem adamant that it doesn't exist.
And added the info that it's -S11(6) of the Immigration Act -that I read in one blog.

Does any one have advice?

Apply for it when you get to SA.
My partner is South African and lived in the UK for 12 years, he went back a few months ago and I am going over to live in 3 weeks, we are applying for my LPP via an Immigration Consultant once I get there.

Hi Philip

I have no idea why the SA Embassy in Madrid doesn't know about it. It does exist and it sounds like your life partner (not girlfriend then) does qualify.

If they are unwilling to accept your application (since they don't seem to know about it - very strange), then you will have to apply and collect your permit elsewhere.

Philip, I forgot to clarify your other point:

Should you and your girlfriend want to stay in South Africa, you would need to apply for what is known as a relative’s permit on a life partner basis, under section 18 of the Immigration Act. Unfortunately the Department of Home Affairs does not specify this permit on their website, they only specify an accompanying life partner/spouse (section11), which applies to Foreign Nationals who have obtained a residency permit and have accompanying dependents. The requirements are the same.

Very complicated I know.

Deb, I was interested in how long it will take through an agency in SA, instead of doing it yourself?

Jess from IMSA, I e-mailed the embassy in Madrid again, insisting that there is Life Partner Permit.

They realized there is, but said my life partner can´t work. Is there a law that I can send them for the work endorsment aspect.( so they realize it exists)

Also, I´m about to leave to SA, Can my other half apply on her own, before coming over soon after.

Hi Philip

That sounds like you are making progress. Remember that the Life Partner Permit is a permit, and the work endorsement is not a permit. An you cannot work without a work contract (better a permanent one without an end date). So I don't know why you are concerned about the work endorsement yet. Get the LPP and then worry about the work endorsement once your lady has a contract.

She can apply with or without you - it's her permit. But she must pick it up where she applies. So if she applies in Madrid, she has to wait until it's ready.

To answer your question to Deb, agencies can only do it as fast as Home Affairs approves, but they are experts at following up and knowing when and where to submit. My only advice to you there is to use immigration lawyers, no other kind of expert.
