Hi everyone. I started working as a nanny about a year ago, and frankly dont underatand the law and regulations! Frankly I dont even know how many days holiday I am supposed to get :)
I have some specific questions, due to my contract being so vague...
I look after a 8 year old, at my house and provide at least one meal and snacks during the day at my expense. I am paid CHF 15 per hour, and average on 5 - 6 hours per day.

1. How many days holiday do a person get per year?
2. How are holidays calculated, does it include school holidays or not?
3. Do normal rates normally apply if the child sleeps over, or how do you calculate this?
4. When is holiday and sick pay paid out if not used?
5. How many sick days are you entitled to per year?
6. If I am informed at short notice that the boy will come for the afternoon, is that hours lost for me?
7. If he stays an afternoon but has an hour sport during this time, should an hour be deducted?

Any help with especially the laws around holidays and rates will be a great help.
Thanks so much!

Armand

You said your contract is vague, and you did not supply specifics, but the fact the child is at your house and you supply a meal at your costs, rather than you taking care of the child at the parent's house, I would rather think this is not really a employee type nanny position. It sounds more like you have a contract as a self employed home care provider. This type of home day care is actually not uncommon in Switzerland. If so, you have no option for sick days or vacations as you are not an employee.

So the first thing to check in your contract is to see if anywhere it calls you an employee. If it does not do so clearly, then you are most likely just a contractor without benefits.
