Same is the case with me, Some say green to green is not possible but others say there is no problem in transfer to a new employer even if the previous employer is in green.
I am still not sure about it as i am going to be released after december only a few months after my transfer and will have to find the challenge of finding a new employer.
Green - Green : Transfer only possible after completion of 2 yrs
Yellow - Green : Transfer possible without completion of 2 yrs
Red - Green : Transfer possible without completion of 2 yrs
Green - Platinum : Transfer possible without completion of 2 yrs
Hope this is clear now.
Clear Now, It means i have to find a Platinum category company to get transferred now. But then i wonder how did the my current company take my transfer although i have been with the previous individual kafeel only four months and he was also in green. In fact, i have been in Ksa since Jan 2013.
If you are in KSA since Jan 2013,then I am assuming that your transfer happened after April 2013 and before 4 Nov 2013 - which fell under the amnesty period when it was allowed to transfer from any category without the grace period. Now that the grace period has ended the rules are back in place.
Hi
I came to KSA before 2.5 years. My sponsor was not good so after 2 years in the month of June 2013 i take away my iqama and passport and applied to new company by paying my sponsor a good amount of money and its along time my transfer is still pending and i am getting threatening from my previous sponsor to get black listed if things not done so far.My new company always replied your transfer is under process.still not replying any thing so far.i am in critical situation. Please let me know what to do.
good day sir can you explained to me the status about my iqama because when i check in online inquiry its shows that
Evaluation of the facility: Green Average Licenses the facility: Permits valid establishment.
i have plan to transfer to other stable company it is possible to release me and can you give me some step what can i do if other company is approved and give me signal to start to work in there company.
How to transfer the sponsership
because my kafil have red cetagery and could not renew my ikama
what is the procedure
Hi HR guru,
Hi, My Name is Sreenath. I am from Kerala. India. I came here to Saudi Arabia on 2009. In 2011 I got Job in one Insurance broker and I completed my contract on 2013 June. During this period I transferred my sponsorship to this company. After the expiry of contract I asked them the salary increment and they rejected. I advised them to I don't want to renew the contract. By March 2014 they revised my salary (only 480 SAR after 3 year) and I gave my consent to renew the contract. But until now it wasn't prepared. By April first week I got another offer letter and I resigned from the company. In 9th April 2014 the company accepted my resignation and they issued one memo regarding the resignation acceptance. In May 1st week when my resignation period end, they ask some days extension for the notice period. I obeyed them and I served them for next 1 week. But Once the extended period end, I ask the permission to join another company, but the GM send one email to the HR and me that my duty period ended and they want to make the final exit on me. During my last working days I submitted the demand letter to the company (chamber attested). Now my existing company is trying to do the final exit. Please advise me to what I want to do.
Please note the below points
- I was locally hired to the company
- I transferred my sponsorship to them (it cost me around 10000SAR)
-Company deducted from me for the profession change (2 times SAR1500 each)
- Exit re entry charges is from my pocket.
- Part of air ticket I want to bear.
- Iqama renewal cost and govt. levy they are deducting from me.
I just need the following documents from them
-My Passport
- Release Letter
- ESB for 3 years.
Kindly advise me to get these documents in legal way....
Regards
Sreenath

Legal way is to approach the labor court and presnent your case to them, but to do that you should have proper documentation on everything that happened - like what you paid for the transfer, what company deducted from your, copy of your resignation, their acceptance of resignation, any good conduct or appreciation certificates / letters that you have so that you can safeguard if they complain against you.
Collect all of these, but before you go / approach labor court know that chances are very slim and that a ruling in your favor does not mean compliance from the sponsor and that such things takes time. In any case prepare yourself if you want to go down that road, if not speak to HR and tell them clearly that you have paid all of these and that you have resigned and you need release and if they wont then you will go to labor office. Perhaps they might try to settle this and release you before .
Good luck.
Thanks Guru, Appreciate your speedy reply, Today I went to labor office and I filed my petition. In my expired contract also, its clearly mentioned that upon termination of contract they will give sponsorship transfer for the locally hired employees. I want to know, If there is any specific labor law for safeguarding this clause in contract????

None specifically, the employer has the right to determine, even though there was a proclamation from King in 2009 , it was never made into a law.
Dear HR Guru,
I got an offer from a private company in Jeddah. I have received release letter and other required documents as well as passport from my present company, which is government company under ministry of National Guard. I have few clarifications;
1. Should my documents need attestation form Chamber; our government relations office in present company mentioned me that it is not required, since it is under ministry.
2. whether my family must be here in saudi at the time of transfer; presently they are in India on exit-reentry for 7 months and not in a condition to come back during this period.
3.How long it will take for all transfer procedures.
Much appreciate your prompt response.

Yes, no need for attestation the stamp is enough since its ministry.
No need for Family to be here during the transfer process since your sponsorship is being changed and your family is under your sponsorship.
The time duration depends on your new organization and the person who is doing this process for you, it can range normally from 2-3 days to 2 weeks.
Thank you very much HR Guru for your speedy response;

Your current sponsor will prepare the release letters and will hand over the passport and iqama to you ,if the iqama is with you already you keep it. The medical card and other ID's provided by the employer will return to them.
I want release letter because my sponsor have no work for this call me.
Now I'm full day free. And last month pay not give me yet.
Any solution for this problem.......?

You cannot have release letter just b'z there is no work with your sponsor, nor b'z he did not pay you for a month. He could pay this back any time and then you wont have a case. If he is in red category under nitaqat then yes you can get a release without his consent, if not best to speak to him about lack of work and finding another job and settling things amicably.
Getting a better offer is easy, but getting iqama transfer from your current employer is very difficult. In this article, they have explained in detail the procedure to search for a better offer, secure the offer, let your employer know about it in best possible way, get release letter and ultimately transfer your sponsorship. I hope you would like this effort. life-in-saudiarabia.blogspot.com/2014/03/switching-jobs-in-saudi-arabia.html
Hi,
I got 3 release letters and submitted to new employer, they asked for online approval.
My previous employer don't have second level of online subscription so he can not accept online request.
Now, How can the transfer can proceed? is there any way ?

Syed

You need your family to be back in KSA if you are planning to leave KSA on final exit. The final exit stamp will have to be stamped on their passports as well and also the iqama that they have needs to be cancelled along with yours. The process is to apply along with your final exit to passport office and they will do it. If this is not done and they stay back on ERE, will impose a ban on their passports since the visa was expired without a reentry. Better to cancel in order to avoid any future complications and if you are planning to come back to work in KSA in future.
Dear HRGURU,
kindly check my query as well

Online access restriction could be due to poor nitaqat status. The solution for you to is to explain this to the new employer they do this the old fashioned way by going to passport office and labor office to do the transfer manually like before rather than online.
Thank you HR Guru for your prompt response;
Sorry for disturbing you again; Is there any way that I can cancel my family's exit reentry and make them on final exit without bringing them back, as they are not in a position to travel soon. Their Iqamas are with me. Their re entry visa will end on 06/01/2015 and my Iqama is valid until 10/01/2015.
So I want to get final exit without bringing them back due to the said reason. Please inform me is there any way for that by surrendering their Iqama and make them exit first.
Sorry for continuous disturbance, hope you can understand my situation.
Thank you very much.

Under normal cases this is not possible since they have a valid ERE and iqama. The possibility is to have the iqama for the family and ERE to be expired. So what you can do is wait for their iqama's to expire for the family and then approach jawazat with the original iqama's to give them final exit. This way they can be out of Kingdom and you can Exit for them without bringing them in.
Ok..now its clear..Thank you very much HR Guru for your clarification.
Thx GURU
My X employer don't want to subscribe for online service,
and new employer is unable to perform transfer without it.

Either one of them should help you out in this case, ask your new employer to support you with this at the labor office.

I am in saudi arabia on transferable iqama of technician, but i am a looking for teaching job, how the transfer occurs
Change your profession of course !!
razeeq wrote:whether government relationship office permits job on transfer iqamah
If you find a job as a teacher, then that school / institution will give you the papers required for you to transfer your sponsorship. You can either change your profession at the time, or to save time since you have the intention change the iqama profession now to teacher provided you have the necessary certificates and qualification and then change the sponsorship.
Dear ALL,
Help me with this questions Please.
1. When I apply jobs online, I always read this .
a.) should have transferable Iqama
b) transferable Visa.
Q: are they actually the same or not?
2. Transfer of Sponsorship can occur even though you have not work for 2yrs with your current sponsor? What if i only worked for 2 mos. and I need to transfer sponsor, can I do that?
3. Ive read i need three release paper from current sponsor, same content but different addressee, and need to be attested.
Q: Is it me who will bring the 3 letters to COC or my sponsor should do that. because it could be a hassle to my sponsor's part and he can just ignore the transfer instead.
4. If my sponsor sent me home and issue exit re entry visa (What if I did not returned on the specified date) am I block listed to all GCC country?
Please help.
Thank you

Yes, the same.

Yes, provided your current sponsor / employer is willing to release you to new employer.
3. Ive read i need three release paper from current sponsor, same content but different addressee, and need to be attested.
Yes, one to the new company, one to manager passport office, one to manager labor office.
Q: Is it me who will bring the 3 letters to COC or my sponsor should do that. because it could be a hassle to my sponsor's part and he can just ignore the transfer instead.
Yes its your part to get these letters and then your new company asks old / current sponsor for release online .
4. If my sponsor sent me home and issue exit re entry visa (What if I did not returned on the specified date) am I block listed to all GCC country?
There have been talks on unified data on such cases where people leave on ERE and dont come back among GCC countries but nothing implemented as far as I know.
Please help.
Thank you
