I need help on my esd application...

The employer makes the application for an Employment Pass to ESD using their online registration system.

I applied before online on esd application but unfortunately rejected...
Now I cannot see my processing online...
I need to know is there any chance to submit again or not?
If yes what’s the processing?

Dear Gravitas,
My application for EPII also the same problem as rejected with no reason.
But, when we go to damansara MyExpat, we just know from officer that why company need Customer Service Manager (International) from outsider ?
We agreed that this is the good question and should not hire this position from outsider if not necessary.

But company have problem that for communication to open a new market in Myanmar. This is our justification and request to MyExpat that ''the position applied is to communicate with Myanmar side and must understand of their culture including the export & import procedure of them and related field experience would be 4 to 5 years. And also the applicant need to travel back to the respected country and must explain about our products with more details. ''

This is what our company submit our actual requirement for Justification.

I'm wondering if you could give me some advice on this appeal.

The reason immigration has given was based on the wording of the Job Description that was sent to them and it seems it did not mention anything about Myanmar. In which case a local candidate would be sufficient.

Immigration do not like it when a company tries to hire a person and make everything fit together just to get that person onboard.

The first step is for the company not to appeal as it is a different job now with a different JD.

Second step would be for the company to advertise the new job and collect applications.

Third step would be for the company to be able to prove that no local candidates or Burmese speaking people were available for the job already living in Malaysia.

Then a new application could be submitted to immigration.

Are there any chances of EP visa process delay due to currently ongoing elections in Malaysia?

There are no elections currently going on in Malaysia yet.

There have been some public holidays for Thaipusam and Chinese New Year etc.

The average time seems to be about 1 month to hear whether an EP application has been successful.

There have been successful applications discussed on this forum during January and February. The process is a bit complicated as it has many stages which each take time.

Thank you. Also one more question, is it possible to work from India itself till work permit is processed and get salary in Ringget and then join  the company in KL once work permit is processed?

Company had submitted the appeal with justification letter but it was not changed anything on Job Description and position.

Between 3 months or later on, if there is rejected again from MyExpat, can we apply New Position for my case? Would Immigration allow me to apply EP again for the suitable position according to the law?

Nupur2193 - You would need to discuss with the company to see if they are able to accommodate that arrangement.

The new job description and vacancy can be advertised. You can apply for the job, alongside any other candidates that have the skills required.  There is no guarantee you will get the job though. Immigration dislike companies trying to hire a particular person without the proper competitive process being completed. You stand more chance with an accurate job description. But again, most companies would probably get agents in Myanmar to represent the Malaysian company and its activities.

Basically the procedure is to provide additional and not-before given background about skills to support the recruitment of a foreigner- https://esd.imi.gov.my/portal/pdf/emplo … cklist.pdf

Note: "Justification for Appeal"

This can sometimes be proof that via a competitive selection process, there were no local candidates available. Some positions are simply not possible for foreigners, especially ones where foreigners would have supervisory roles and usually middle management positions and above are rarely possible.

The company has an online account with ESD and processes the appeal through that system. Immigration review the appeal material and react accordingly.
