Hi there,

One of the company in KL, Malaysia is trying to apply EP for me under Information Technology cum Multimedia with the package of RM6k per month.

My Profile:
Single
Indian
Diploma with more than 5 years of experience and currently working in UAE.

Company Profile:
More than 20 years in the industry.
100% Locally Owned.
500K Paid-up Capital.
Never Hired foreigners before (Now they started to register with ESD, almost at the final stage).
Nature of Business:
1.CONSULTANTS, SPECIALISTS, SERVICES PROVIDERS IN THE FIELDS OF BEAUTY, HEALTH AND BODY 2.AGENTS, DEALERS AND WHOLESALERS OF ALL TYPES OF BEAUTY, BODYCARE AND COSMETIC PRODUCTS.

Current Status: The ESD is asking for Justification Letter.

So now my question is What is the possibility of EP approval here? my previous job title & descriptions should be relevant to the applied position? How can we give justification to hire? Is there any advantage/disadvantage since the company is new to hire foreign talent? What is your thought?

The company has to show it has advertised the job and there were no Malaysian applicants suitable to appoint.

Basically if the skills are available in the Malaysian workforce there is no need to hire a foreigner.

Still, I have some more queries..,

Do you think is there any special consideration since because the company is new to hire foreign talent and it has good paid-up capital and more than 20yrs in the industry with good financial records?

And is there any way to convince them saying that the allocated budget for this role cannot be filled with local because the industry is paying more for the same experienced local talent but still they can able to fill with expat?

Hello Gravitas,

I have one more query,

As of now, The ESD is asking for the Justification Letter while the company trying to register & activate their account with ESD at the first time. So if the ESD suppose approves the Justification and activate the company account then at the time of their first EP application do they reject the application? for the same reason (justification) or any?

Of course immigration may not find the justification put forward by the company to be strong enough proof that it is necessary to hire a foreigner and still reject the application.
