I'm shacking my head in disbelief as I now know so much better, my heart took over because I love the house.
Does anyone have any ideas on how to tackle this lady,  no pun intended ?
I have spent the last week in bloody hospital, I gave my address, I just really hope I don’t have the police here, I live alone and not really met any other expats or Vietnamese yet! It would frighten me.

If you received no contract yet let  her know you will contact  the Tax Dept.

Here is a tip, something I use. Get a nòtebook, when you are going to pay rent or a deposit, get the owner to write the date, the address of property and how much is being paid and sign your notebook. Many times what you pay them is not what's being declared. When you want to vacate and they start their crap, pull out the note book and mention the tax department. Scares the hell out of them.

For the visa you can put down any address of any hotel in town if you want they don't really care. As for the landlord, the money is gone once you handed it over. It's best to just stay there until your lease is up. Don't worry about the police showing up. They can't really do anything to you. Give them the landlord's phone number and have them call her. Make a scene and be aggressive if they start to harass you. Tell them you will contact the embassy if they don't go away.

You paid 45 million and didn't get a receipt and now she avoiding you?
Is she the landlord or the agent?
If she is not the landlord maybe she's not authorized to rent the house.
Maybe she only collect the deposit for an untenanted house. 

Bloody messy for you mate. However just thinking seeing as though there is no contract can you get your money back (ust thinking that may be difficult too) and move on and find a more reputable landlord/agent. Is there a local Chamber of Commerce for foreigners? Hope it all works out for you.

Hi,

I just wonder why you didn't ask for any receipt or evidence that prove your payment to that lady.

The reason that lady doesn't want to make a contract  is that she has to pay her personal income tax (PIT) from the renting income (45 mil VND from you). According to Vietnamese law, with the monthly income from 32 mil to 52 mil VND, PIT-to-pay to tax department is 25%.

So the solution now for your renewal/extending a visa is asking her to make a "Contract for borrowing her house in a period time"- in this contract, she just declare that you are her friend and she lend you her house (no money mentioned in this contract). Both of you can get benefit from this contract: you can extend your visa and she will not pay her PIT.

I'd be contacting immigration.  They were a large help to me back some 4 years ago.  The local police will do little to nothing.  Why did you not get a receipt?

I got a yellow stick it note saying 45 million paid, it hadn’t wrote, to what address or any details.
(I’m shaking my head as I’m writing this) I am so far from STUPID and have plenty of common sense, but obviously not with the situation I am writing about, I can’t believe I even spent 2 days reading the local laws on tenancy!!
I’m hoping that when she returns from London tomorrow: she isn’t on this site!
I have to get my Visa extended. Does anybody have any advice on getting a 1yr business visa rather than a  3 month tourist visa?

Go to your local ward police and ask for the link. Each provence has its own registration site.

i have been looking for it online and no result seems right. yeah i guess i have to go to the local police station and ask for it. thanks!
