Highly skilled immigrants spouse visa

Hi all,

I am new to this group. I just moved to Netherlands. I am a highly skilled immigrants. i moved to Netherlands in May. My lawyer applied for the spouse visa for my wife after my arrival in the Netherlands on 28th May. And then they sent a letter of reception within 2 days saying the decision date until 24th August.

My lawyer told me in the beginning that it will take 2-3 weeks because it's highly skilled immigrants category. In my wife's visa i am the sponsor and also my employer. We provided the appostilled marriage certificate as well. I heard that in the Netherlands visa process is quite faster as compared to other countries.

So i wanted to know from other people who passed through the same situation. And specially if you had experience with highly skilled immigrants.

Hi and welcome to the Forum.

I'm a bit confused by your explanation, so just to clarify, did you arrive in Holland as a result of a highly-skilled migrant job offer (i.e. your employer applied for your visa), or have you come in via the EU Blue Card or Entrepreneur scheme?  I think the issue lays where you say "I am the sponsor and also my employer".

If it's the former, then normally your employer would co-ordinate both visas and you would travel together; it's normal for this type of visa to be expedited ahead of others and normally does take 2/3 weeks - simply because the sponsoring employer's information is already registered with the IND and a work suitability check is not required.

If it's the latter and you've used another scheme, I'm not aware of any favourable treatment for such applications and your wife's suitability for the job will be investigated as part of the process.

The only other explanation I can think of is that perhaps you've applied at the worse possible time with many staff on their summer vacation.

Perhaps you should ask your lawyer for an explanation of the delay?

Thank you for your answer. And sorry for my wrong explanation. Yeah i am here on highly skilled visa which my employer did that for me. I got the visa in 1 week. Unfortunately at that point of time we didn't have marriage certificate. So the lawyer who was hired by my employer applied it at end of May.

At that time she said that it will take around 2-3 weeks. But it's one month already. SO i was wondering if there is something or it's normal time..??

Ask your lawyer, she's getting paid to sort this for you.

Indeed, your lawyer should follow up on this (with the consulate or IND whichever is applicable). And processing time of a month or so is normal I think.

Thanks for the answer. So the lawyer might have just lied to us. And 1 month time is the same for everyone (for non highly skilled immigrants as well).

I called the lawyer and she said that she has mailed the IND to speedup the process. I hope to get the answer soon.

Is there something that employer can do in this case  to speedup the process..?

IND will take their time for processing. I am not sure if employer can do much here. As the lawyer already wrote to IND, just wait a bit more ! Good luck!

So yesterday my lawyer called the IND and they said that they have the decision. But they didn't say if it's yes or no. They will send the letter. Hopefully it's a yes.
