Expatriate Application Rejected - Appeal

Hi @Gravitas,

Can we able to change the Job title at the time of appeal? Because both previous and new title job descriptions are mostly the same and also we found that new job title in TalentCorp Critical Occupation List 2017-2018.

So do you think that the appeal will be successful if we justify using this TalentCorp list?

and also can you help us how to get a supporting letter from TalentCorp if it is possible.

What was the reason for the rejection - foreign labour not required?  Do remember that Talentcorp is actually primarily for returning Malaysians so be careful using it as a justification. It could just reinforce the rejection.

Talentcorp for foreigners is only relevant after 3 years on an EP with a salary above 15,000 per month.

If it's a middle management job then that is the reason for the rejection. The heirarchy in the work place has to have a Malaysian at the top of the departmental organigram. So check what was submitted.

Immigration are not idiots so be careful not to give them a good laugh.

Thanks for the prompt reply.

The reason behind the rejection was that the "skillset can be found locally".

So is there any way to get a supporting letter from government agencies? If then how?

No - the job can be done by a Malaysian. End of story. What agency is going to say otherwise.

Of course an Appeal can always be lodged but the angle is the availability of a Malaysian. The appeal will require the company to show their selection process and even readvertise.

Did the company check its quota properly.

I added a sentence to my last remark - hopefully the company has sufficient quota to hire "another" foreigner. It can be a rookie mistake. The rejection dialogues are not very specific.
