Hi ,can you help me
1. When will they start to calculate 182 days. Will be the firs date i stayed in Malaysia(15March18) or the first date i start  working (26March18).
And the last date will be the last of my working date (18Oct) or the date i do clearing tax

2. I travel out of Malaysia 3 time , total is 22 days for 3 time , will they deduce 22 days  or not because each time is less than 14days.

3. If until  the last of my working date i stayed in Malaysia 185 days( already deduce 22 travel days ) will they charge me the resident tax. I dont know if i have to apply for the COR  or not , cus i have to clear my tax few week before my last date of work ( if like that , that time i not 182 days to apply for COR)

Thanks

Gravitas

The day count is from first working day to the last i. e. time you were earning taxable income. The 22 days absence will be added to the 182 days to find qualifying date as tax resident because you were not present in Malaysia during those 22 days. (The 14 day rule is only relevant to link tax years) The only relevant tax rule is the 182 days presence in a basic tax year Jan-Dec.

Thank Gravitas,  but right now i have the important thing make me really confuse is the way how they calculate the days i travel out of Malaysia,I asked 2 place already ,first time i go to the tax office the officer tell me that only count the full day outside Malaysia, mean if I go on 8AM 20Aug an back on 8PM 22 Aug , they only count 1 day  (21Aug)  but when i call the hotline of  government  1800885436 they give me different answer that they will count exactly the time i go like 24 hours will count 1 days ( so it will be 2 days 12h if i go on 8AM 20Aug an back on 8PM 22 Aug) ,

And both of officer i was ask they said that they not really sure , if i want to make sure just apply to do clear tax . Im so confusing right now so can you help me , pleaseee !

The answers you got are exactly the same. Just said different ways.

Basically if you are in Malaysia at any time during a 24 hr calendar day that day does not count as being absent because you were here for part of the day
