Not sure about the logic in your question. It depends on when you apply for your work permit extension. If ur existing work permit is not a SP, then the extension will fall under SP procedure. (My existing work permit is not SP, but my extension request was considered as SP. Since Jan 2019, all requests fall under SP, if am not wrong).
And for SP procedure, the Foreign affairs department takes a maximum of 120 days from the date they receive your application.
Here are my timelines
Date of application for SP: 03/05/2019
Date of Admissible: 20/05/2019
Date of SP: 10/09/2019

My existing work permit is not SP, but my extension request will be considered as SP.
I hope i wont get such long delay (May to Sept) after phase one (documents accepted/admissible by ministry)

You don't need to submit your physical hard copy of your existing Work Permit. Your soft copy of work permit and resignation acceptance letter /mail is enough to prove that you indeed will discontinue your current work assignment with your existing employer.

Hi all,
I have received my annex 46 recently, living in 1000 Brussels .
Can I directly go 1000 Brussels commune and apply for my physical single permit card or its mandatory to book an appointment .
I read somewhere that I need to be present on city hall within 8 days of receiving the annex 46 . Finding appointment is difficult within 8 days.
And is there any process to fast track the delivery of single permit card as I cant wait longer with annex 49.

No appoitment needed, you can directly go to the commune. You need to take your current RP and 2 recent photographs ( as per belgium specification). You may ask them for express process in which case you have to pay 95 Euro (appx) to recieve new rp card in 1 day or 45 euro (appx) in 1 week or for normal process 24 euro. commune will provide you annex 49 which allows you to work & stay and can be renewed once in the mean time your new RP is not delivered to you.
please note single permit is nothing but your RP card with labour market mentioned.

One of my friend applied by first week of July. Got Admissibility by first week of September. For me, my employer has applied by first week of August , no updates yet.

This might not be related. But i applied 11 July. Only got a reply 3 September asking for extra documents.
So i suppose july and august were mostly less work for the authorities.

Le délai d'examen d'une première demande par l'Office des étrangers est de 2 à 8 semaines, à compter de la date à laquelle la Région a déclaré la demande recevable (mise à jour : septembre 2019).
Si ce délai n'est pas dépassé, l'Office demande aux employeurs de ne pas téléphoner, ou envoyer un mail, pour demander où en est un dossier (travail supplémentaire au détriment du traitement des demandes).

If this deadline is not exceeded, the Office asks employers not to telephone, or send an email, to ask where is a file (extra work at the expense of processing applications).
I think they lowered the 9 weeks to be from 2 to 8 weeks, does this mean the backlog is over?! Or there still backlog in the regions?

Seems like sometimes they don’t inform the admissibility. I’ve waited for 3 weeks for some news since i sent the application but have not heard anything yet.

i have received two mails one from my employer and another from "singlepermit@ibz.fgov.be".
there are three documents provided in the mail itself.
- Letter of the Immigration Office
- Annex 46: authorization to work and stay in Belgium
- Letter of the region
Anybody here who applied for Work permit renewal via the new procedure and had to leave the country because the Single Permit was not approved before the current resident card expiry?
I work in an expat contract & got an offer from Belgian employer. My new employer has applied for my Single Permit and is under process. I'm currently in notice period with my current employer.
My notice period goes till mid of November. If I get a new work permit by beginning of November, does it mean that I cannot work for my old employer any more ? As far as I understood from the forum discussion, once I get the new Work Permit (SP) the old Work Permit gets cancelled automatically.
Please suggest what should I do with my current employer if I get the new SP in advance (with early start date).
I did not get the update on the Date of admissibility yet. SP was applied on the beginning of August and waiting for the update.
Any information about this would be of great help !

But for the Resident card part, it’s expiring on 2nd October and I have no news about the Final Single Permit approval.
Went to the commune few times and they asked me to wait. Legally speaking, if I don’t receive any response, I think I will have to leave the country and the company should stop the contract as well!
Added to this, I have a Permanent Residence B, application running for more than 6 months, for which I have no response either!
What a mess! All this after paying crazy amounts of tax for over 5 years!

Shouldn't you also wait for the residence permit approval before being allowed to work? I remember reading something like this on werk.be
I think if you dont get the new residence permit before October, you can ask the commune to give you a paper that will allow you to temporary stay in Belgium, something like Annex 15 if I'm not mistaken.
Also, as far as I know, if you have worked for 5 years already, you're new residence permit should automatically change to a permanent one.
But it's a good idea to consult a lawyer, and be kind enough to share your findings with us ;-) Good luck!

I consulted a lawyer and I was told that I can continue to work, as I have a work permit approved and there is still a month of validity on my resident card. But, as soon as my current resident card expires, I have to stop working, in a case where Single Permit is not approved before that! Also, my employment contract should also be stopped.
Annexe 15 is not issued anymore according to the new procedure! - so, no luck there!
You won’t receive a special status/card after 5 year automatically. I applied for Permanent Residence Card Type B, after completing 5years and I’m waiting for an answer for more than 6 months.
Note: Also, I noticed that the current work permit approval document says that it is approved for 3 years!

My commune kept on insisting that the Card B will only be automatically issued in Brussels as they feel like they want to. The bureaucracy of this country is pure madness.

Yes, it is true that your contract should be stopped if you dont get the SP in time, my girlfriend had the same situation when she applied for a renewal of work permit early this year and she had to stop her work and contract for a week until the new single permit was issued.
I still dont think you have to leave the country if you dont get your SP in time, that doesn't make sense at all.
I'm currently also in your situation, applied for a fresh SP and waiting; and my current residence permit expires at the end of October.
Why do you both do a B card request, while you should be doing a D one????????
Most of the time, B card is only for people that regularized their stay and request a permanent residentship in Belgium (refugee, illegal peoples that did stay in Belgium, foreign kids without parents, ...)

Thank you for the information. Can one directly apply for the Card D from the Card A? Do we just have to request it at the commune office? Is there also any other specific requirements? The information for the Card D application seems scarce in the internet.
You can apply for Card B or D. The difference is that Card D is recognized by other EU countries if you want to move and work and you would be part of the civil registry.
My reasoning behind applying for Card Type B is that the rejection rates are low compared to D, simple procedure and ‘less’ time for approval.

Nope. As far as I know, the old WP would get cancelled once the new one is active.

There's nearly no way you'll be denied if you can proof you've always been working in Belgium since your arrival AND you've been in Belgium for 5 years (less than 6 months MAXIMUM at once outside Belgium AND less than 10 months outside Belgium in the past 5 years)
Time to get a B card or a D card is nearly the same... so absolutely no point to ask for a B card (2nd country of residence because of refugee/war/"orphan" from 3th country/... + illegal arriving in BE, while you should get a D card...
You're just eligible or not...
This is NOT a request to the immigration, this is a RIGHT if you're eligible. It's absolutely different!
Immigration will just verify if you can have it or not, foreseen by the Belgian laws.

Your dates looks incorrect. Not sure how can admissibility letter come after WP.
1. Commune will have no answer. Your file has been processed by region and it is with immigration. You may scroll through pages of this forum to find contact number of immigration
2. I came accross below link few days ago. If yours is the case of extension of WP than flanders allows you to work till expiry of your RP. This measure was implented from June. Kindly ask your employer to get email confirmation from region for same
