Being in a Management position in a company, and creating jobs locally + paying humongous, taxes, this is not an ideal state to be, for my company, nor for me!
I will check with my lawyers on what could be done now.. Shall keep you all informed!
Things that I would've done different in my situation:
- Apply for Type D permanent residence instead of B --> D has a time-limit for approval (5 months I guess) and B doesn't
- Apply for Resident Card Renewal (Single Permit) at least 6 months before expiry.
More Updates:
There seems to be a whole lot of mess within departments! WP was approved by Direction Migration économique on 27th August and l’Office des Etrangers did not receive any documents or approvals from Direction Migration économique.
Here's how it is:
l’Office des Etrangers: We did not receive any documents or approvals from Direction Migration économique. Contact them and ask them to do the necessary!
Us: Dear Direction Migration économique, can you plz check what's happening?
Direction Migration économique: If they didn't receive anything, ask them to send us a mail so that we can restart the procedure
Us: Dear l’Office des Etrangers, can you send them a mail?
l’Office des Etrangers: Can't do! They have to send us things...
So, caught between two Departments on an unending cupid play!
UPDATE:
Finally, after a lot of contacts with different departments, Single Permit was approved today and I should get the Resident Card A in the next two days! No news on the Permanent Residence Type B application yet. But, I'm glad that finally there is some light.
Here is the timeline:
Application date: 2nd July 2019
Accepted on: 18th July 2019
WP Approved on: 28th August 2019
SP Approved on: 8th October 2019
Region: Brussels
My Advice:
- If you don't hear anything within four weeks after WP approval, you should get in touch with them to find out what's happening. There is a dedicated Helpdesk to handle these questions and it wouldn't hinder the process!
- Don't push employers and put them under stress, coz it could be counter productive. For a lot of them, this year, they feel that it's too much effort and uncertainty bringing someone over from outside the EU.
I hope all this is solved as the different departments mature and bring in efficient processes to fast track new applications and ensure that renewals are treated with importance!

Hi, congratulations and thank you for your sharing. Do you know after admissable confirmation, if we haven’t received WP yet, how long shall we wait and whom we can contact to ask for the progress, my WP and residence card will be expired soon, I am wondering if I am still allowed to stay in Belgium to wait my WP and SP, I have lived here for more than five years and also waiting for residence card B but no news as well.

After WP approval, I would wait for ~6weeks. After that, your employer can try to get an update from 'Direction Migration Economique'. --> This is where your employer would've submitted the renewal application.
By default, you are not allowed to stay. But, you can go to your commune few days before your current RP expiry and ask for 'Annexe 49'. This would allow you to stay in the country for 45days. If your WP was approved, then you can work as well.
Do not expect Residence card B to be approved anytime soon.

My WP is not approved yet, so do you think that commune will still give me annex 49? Do you know how many weeks it takes to get WP approval after admissable? Tks
Yes! They will still give you Annexe 49, as your SP application is in progress. But, you cannot work.

This is the information from DOFI. You aren't obligated but this is the only way to guarantee you entrance.
But as you're already inside EU, the risk is smaller.

NOTICE: A non-EU citizen who does not have a visa for a stay of up to 90 days is not obliged to apply for a D visa. However, not applying for this visa is a risk.
In fact, a non-European national applying for a single permit must indicate the place where he is domiciled on the application form. If he indicates that his residence is abroad, the Office will send a copy of the decision to the post indicated on the form. On the other hand, if he indicates that his address is in Belgium, the Office will send this copy to the municipality indicated on the form.
The posts and the communes are responsible for verifying that the decision presented by the worker corresponds in all points to the decision sent by the Office , before issuing a visa or a residence permit. If a worker exempted from a visa for a short stay indicates that his residence is abroad but does not apply for a D visa, neither the post office nor the municipality will be able to verify the authenticity of the decision. The position because the worker does not show up, and the municipality because it has not received a copy of this decision.
The D visa is therefore the guarantee that the check has been carried out by post. A municipality will therefore probably refuse to take into account the application for residence permit of the worker who presents himself without a visa D. The Office has decided not to send a copy of the decision to the municipality when the application form indicates that the worker's home was abroad. Priority is given to the processing of requests, not the referral of decisions.
The Office therefore strongly advises non-European citizens who do not require a visa for a short stay to apply for a D visa upon receipt of the decision (Annex 46 or 47). If the domicile in Belgium is already known, another option is to inform this home in the single application, even if the non-European citizen is still abroad when his employer makes this request.

Could anyone help me to provide through which email address foreign police use to send the SP approval in order that I can make sure and search my email box properly.

I saw someone here in this topic who had same your issue, and when s/he contacted the alien office, s/he discovered that the office had a typo in his/her email, you can check with the office if they have your email address correctly!

Hi ,have anyone applied for Belgium long term Visa from India ( whose application is submitted to Consulate in Mumbai ) after the usual procedure of getting Single Permit.
Just wanted to know how many days does it take after the Visa appointment with VFS. I have heard it takes 15 days, but for many ,it gets Visa approved within a day or 2 .So just to know if anyone got Visa recently.
Sharing my strange situation... My Employer got email with a document stating my SP is issued, and they have sent the approval notice already to me. The document also has details of my previous permit from 2013 along with address, rp no etc.
However, I didn't receive any email from them yet. Me and employer both have send email to ask for the (re)delivery of document needed for visa.
Has anyone faced such delay or similar situation?

Employer received letter regd SP: 10 Oct
SP: ...........Still Waiting.........
I’m nearing the end of this process and still have no scheduling certainty. It’s miserable trying to move a family with no timeline.
The biggest loser in all this is the employee’s family. The second biggest loser is Belgium.
Trying to stay positive, but don’t understand why we do this to ourselves...and this applies to visas in many, many countries. Deep breadth, and dreaming of a world of no borders.
...it’s just so hard waiting....

Annex 46 is single permit. Yes you can apply for family re-union post arrival of single permit. Basically u can apply for ur visa and ur family's visa together ,once u have the single permit. Your SP will come around 11 feb ( max)
