Employment Pass

Post new topic

ajreyes06

Please help me. I had been offered a job in Johor Bahru as an Engineer (direct hire). I have a few questions
1. How to verify if personal bond has been paid by the agent? I had the receipt copy. I just need to verify it.
2. The company had sent me an approval letter for my employment pass. How to verify if document is true?
3. After paying the personal bond, they said the immigration is asking for the following documents for me to get the original copy of the EP approval
-Certificate of Good Conduct
-Health Certificate
-Commissioner of Oath / Deceleration
-Police Clearance
-National Bureau Clearance
If I wont be able to provide these within 2 days, they said I might need immigration lawyer and bypass it with employment insurance policy. Is this procedure correct?

Sounds like a job scam. Security clearance is done at Ministry of Home Affairs level and not by you submitting documents.

For Filipino workers coming to Malaysia you also need the Labour Services Office to approve the recruitment.

http://philembassykl.org.my/labor.htm

Medicals are arranged through special clinics authorised by Fomema and you would need a referral

You would also need a Visa with Reference approved before you could enter Malaysia for work purposes. The details would be me mentioned in the  Visa Approval Letter. A real employer would just forward a soft copy to you once medical clearance and other formalities were completed

ajreyes06

I verified the CRN. It exists. Below is the process the HR had done after the offer letter:

1. Fill up Form DP11 and Personal Bond
2. EP Approval Letter was sent and requires personal bond payment (1000MYR)

Here is the email
"Herein attached is your approval letter that was approved this morning by the Immigration,  we still don't have the original till the bond is settled, we have 2 method of payment which is as follows:

Pay in Cash at Immigration office Putra Jaya Malaysia, If you have anyone staying in Malaysia or a firm you can contact to pay on your behalf kindly inform us so we can contact them to visit our office.
Sending directly to one of our EP runner via Western Union
You need to make RM1000 (13200pesos) payment today to enable us get the approval copies from Immigration so we can prepare other needed documents before sending the original to you via DHL, after receiving the original copies we then book your flight ticket to a specific date before the deadline day to start your probation.

Once you choose your payment terms inform me immediately to guild you through the process.

Thanks for your kind"

3. After Payment, they sent me this
"We manage to pay for your Personal bond this morning herein attached is the receipt, but we also need to update you on some documents which the Immigration needed you to provide, because we didn't manage to get the original copy of the EP Approval. You need to provide us with Certificate of Good Conduct, Health Certificate, Commissioner of Oath / Deceleration, Police Clearance and National Bureau Clearance. Everyone who wishes to enter Malaysia for High Employment basis must be of good character. In order to determine this, the Department of Immigration and Ministry Affairs may ask you to provide a police certificate which is the COGC.

This documents will be needed when you arrive at the airport, you will present it to Malaysia Immigration on arrival when our EP runner will pick you up, that's why they withheld to release your original approval working permit and visa. If getting this documents will be hard for you, we also can help you get it with our immigration lawyer "IF" you choose to use our legal help, we will bypass it with Employment Insurance Policy but it will incur some charges, will send you forms to fill and the charges list if you're interested to use our terms only takes 1-2working day. But if you choose to provide all the documents yourself please do provide the documents before 10th May to avoid immigration imposing demurrage/penalties."

It is Definitely a job scam as they are asking you for money

ajreyes06

Thanks! Will be doing a thorough investigation tom!

Read the link I sent you to understand the process of clearance in PH. It usually takes at least 1 month to get their approval

For future reference:
Here is a link where you can find a Checker* and a Quick Guide which explains proper recruitment and immigration processes in Malaysia. In Annex A it explains all the paperwork required by immigration

https://esd.imi.gov.my/portal/

*this is the ESD (expatriate services division) checker. Engineering jobs would normally go through ESD. However some jobs mainly ITC are recruiting through MDEC which has no checker

Gravitas

A company called Oriental Oxygen seems to be having their name used in a scam for various jobs in Johor

Gravitas

This is a very cruel scam because they keep using different ways of getting money out of you. Buying Employment Insurance is the next step which doesn't exist for recruitments in Malaysia. They also threaten with penalties and other fake charges being levied by immigration which simply don't exist.

No legitimate employer asks for payment of a Security Bond or any other recruitment expenses.

Help yourself by reading the thread

ajreyes06

It's a scam. I already reported my concern to our Embassy in Malaysia two months ago. I also met two other people who where scammed.

mhypejante18

Hello Gravitas

Have you heard about Main Constructions BHD?
My husband has been offered a job by this company. Same with others, we have already paid the RM1000 security bond. After this payment HR required us to produce certain documents same with ajreyes.

When we verified further with HR, here’s the response:

If you want to use our legal help in getting all the documents, that means everything will be included because is base on insurance policy and everything will be insured will only take 1 working day to get all documents, herein attached is form you need to fill, if you needed our help.
On the medical form fill only first page. Herein is the breakdown fee:

Declaration signed by the Commissioner of Oath - RM200
Letter of Good Conduct Base on Employment Insurance Policy - RM510
Medical report approved by the Ministry of Health Malaysia Base on Employment Insurance Policy which we  will deposit RM1800 on your behalf - RM290
        Lawyer/Runners fee - RM600
        Total RM1600 - PHP 19,900

We still cast doubt whether the offer is legitimate so we asked them why are there penalties when the approval letter is valid for 3 months. Belows our convo:

The approval letter is valid within 3 months from the date of issue, then why would there be penalties if we cannot provide documents on the 29th? [HR]This is considered as a per-approval, we still need to process your Work Permit, Visa and Entry Permit so the process is still 80% undone because after you get above mentioned documents we still need to send to Philippines Embassy to get Per-departure certificate and endorse your Offer letter, which we will then send all your documents to you to enable you go for seminar with POEA, so is not that easy process, we need to finalize everything before 2weeks.

If you may, can you give me the immigration website that indicates these documents so I can check thoroughly? I cant seem to find these documents as part of the requirements. [HR] Herein attach is a screenshot of the Immigration website that required you to get the said documents, you can check yourself by going to the website as well.

I am sorry but I am not comfortable with paying additional fees unless I have validated that these documents are really necessary. I hope you understand. [HR] Am sorry also we will cancel your Approval and Offer is you didn't provide the documents as agreed. Your personal bond is nonrefundable because we already paid it and collected the receipt, you only need finish the contract before a refund can be issued.

The job offer is advertised by the way at a reputable job hunting site. HR is using job@mainconstructions.com email add during our conversation. We tried asking for the company CRN but they won’t provide

cmc1994

Hi! I received a job offer with the same company. It will be a great help if we can update each other with it. I am currently searching on them but I couldn't find them in any news regarding construction but seems legit since they have a domain of their own and a website. But when you go to their website and click blogs for "read more" it will just redirect you to the home. Do you have an update already on this?

mhypejante18

From Main Construction too? Did you apply through a job hunting site? We went to Malaysian Consulate and brought the documents they sent us. They confirmed even  at first glance that the documents are all fake. The personal bond must be paid between agencies and the employees should pay nothing. I hope you haven't not paid anything yet.

cmc1994

Yes, with the same company. I already paid sadly :( but good thing I did not go any further at this moment since I did not have my passport yet. Thanks for the information. Did you already make an action on this?

mhypejante18

We will elevate this matter to proper authorities so they can track these scammers

mhypejante18

We are thinking of elevating this concern to proper authorities so they can take actions against these scammers.

cmc1994

Oh if ever you'll do that I could help too. Thanks!

princessjdc

Try asking help from embassy and police. I emailed before. Police said we should file a police report for them to start criminal investigation. If you are not from Malaysia, please file a report in your local police then they'll seek assistance thru interpol.

I also got the same email but I think they are now using a different email domain. I received this one from Abdan Prestige Holding Bhd. (job@abdanprestige.com). Their email and website is quite legit and too good to be true. Good thing I found this thread and haven't paid anything yet.

Hi Gravitas,

I hope this email finds you well. I would like to ask for assistance about my current situation here in Malaysia. I was terminated by Concentrix and my last day duty was last July 6, 2020. Fortunately, I was hired by another company, however, the company is asking for a Release Letter from my previous employer wherein according to Concentrix, it is their prerogative and company policy not to provide this Release Letter. The new employer is willing to buy me out although I am no longer working with them. Is it allowed for them not to provide us with this letter based on the law? Would there be anything that I can do to get hired even if without this letter or going back to the Philippines? Given the current situation all over the world, I can't afford to go back home knowing the fact that there is an opportunity here for me. I would really appreciate your assistance in this matter. Looking forward to hearing from you soon.

Thanks and regards,

sieril0927
