Gappy  dont go for the second test if there is a way...

Discuss with the PRO if you are here for a company..... Tell them the story try to get visa cancelled and go home..... If not, you will ( chances are more) get banned and they will scan your eyes and that is it... even visit visa will be a problem...

I also agree with what you say, all we can do is hope for the best and pray and have strong faith to god almighty. I know that he will answer all our prayers...

Yes it might be taking a little time, but what else can you guys do? I lived 35 years in UAE since it was nothing but desert and now I cannot go back because of this rule. UAE is home for me and not just an opportunity to work as the case with most of you. Moreover, I just declined an excellent position in Abu Dhabi. Nevertheless, I'm still optimistic things will change.

bottom line, do not write these emails to any official. It will only have an adverse effect. No need to spoil things at the last moment.

Even before the implimentation of the new rule person with hbsag were not allowed to work in the above mentioned groups..But at that time even if they are unfit for such jobs they could easily change to other job without the deportation.

Now as far as renewal is concerned only these group ( above mentioned groups)will undergo for hbsag. ( Hopefully they are free off hbsag since they have a visa for such jobs)

I am a long time follower of this site, it is extremely informative!

I have a question and I hope that you can pass on your advice….

Firstly some background:
I am in the process of securing a job in Dubai (Jebel Ali) inshAllah.  I have successfully passed the first technical and HR stage.  I am a British Citizen (if that makes any difference?) and will be working for a British company (again, if that makes any difference?).

It is a specialised role and not easy to get many people with my specific skills.  If I am successful, the role would begin after Ramadhan now, so in September 2010.
The role is very interesting and has come up after a long time of waiting. 

Unfortunately I am HepB positive - other than that healthy.

Should I inform the employer now at the next interview stage(?) to find out if the company will fight for my medical to be ‘fit to work' and working visa to be issued?  OR should I sign my contract (even though it is subject to medical) and then tell them?

I would really like to know the best way to proceed with this.  Am I just kidding myself and walking into a minefield?

**Ignoring the medical HepB rule change (hopefully this will officially happen soon) should I continue ahead with this venture?

This forum is really very helpful. I even could say "I was born for the second time" because of this forum. After being here (in UAE) for 8-years I was about to be deported from country which is in fact became as my home.
Without people's experience on this forum and their sharing I would never get my visa stamped.
O key, now I strongly advice you to wait if it's possible till this rule change. As I know it will be very soon. It's not up to your company HR or PRO. They can't help you if HBV test exists.

To best of my knowledge no deprtation for hep b in 2006.... He may be denaid for the private driver job.. thats all .. something went wrong???

          I am not very sure abt anything but the guy who talked to me,told me very clearly that as long as this law persists,no Hbv positive will be issued visa.My brother has the same problem n when he gathered information,the UAE embassy in our country told him to get an authentic fitness medical report n get it attested from UAE embassy.Now  I am not sure how much it's going to help but the guy at UAE embassy told my brother that most of the people don't do any home work n come to UAE BLINDLY so they face problems.With good home work prior to leaving your country may help.....rest only GOD knows!!!!!!

as every body is anticipating the change in this law, you should buy some time from your potential employer before applying for the residence visa. Your job should start in September, that is three months from now. On the other hand make it clear to your employer that you prefer to stay on visit visa during the probation period which is by UAE labour law is three months. Free zone companies might have some window there to extend or shorten this period. Regardless, if you do so you would buy yourself at least 6 months during which a lot could happen.

As a British passport holder, it should be no issue to stay 3 months on visit visa


Also, suppose that you start and after 6 months the law does not change, you should have proved yourself at work and given stronger reasons for your employer to fight for you.

Today, I have just submitted my documents for renewal and my employer will inform me of my medical schedule soon. sorry guys...as far as i know.... the hep b   status for 6 categories  was always  there and they  were never allowed isas if positive.... but employment visa for other  categories was no problem till 2008....

Thanks for your comments & advice to date.  I appreciate it.

I am hopefull the law will be amended although if I am correct, I believe that the HepB requirement had been introduced two years ago on a 3 month trial basis. 
There is no guarantee that a) the rule will change and b) if the rule does change, at some later date it reverts back.

One thing not to lose sight of is hope, "whatever happens, happens for the best".  So if this rule is not changed then maybe it is for the best!

Absolutely agree.
Whatever happens happens for the best.
Who knows, you may get better job in UK.
Dubai is good for tourism. Or for short term work.
But if you are here for longer time, that's it you will be stock in here.

Has anyone tried applying for a visit visa after being banned? Was it successful?

I knew that the rule was older than 2008 9despite what I read here 2 weeks ago, so there seems to be one (or more) guy in this forum that claims to be in the knowledge and in fact is not.

Please post what are sure of, not you heard, dreamed or read in an other forum, there are too many people relying on what is said here and that could have deseappointing surprises.

My visa pasted today but its renewal. Remember for renewal I was tested only HIV even no x ray. But for renewal, categories does exist. I am not in those categories.

On Sunday June 6th, UAE Cabinet has approved the proposal of the ministry of health to amend the list of medical tests required from expats for residency.

So, it will be in the news by Monday June 7th. I suggest that you guys check the following news papers by Monday morning:

1- Gulf news
2- Khaleej times
3- The National

if you are outside UAE, you can check the websites of these news papers.

The law is changed; the only question now will this be taking effect immediately? that remains to be announced by ministry of health.

There's a short story in Gulf News.. Medical Check-ups to undergo changes.  The ministerial Service council approved amendments to the medical check ups system for expatriates in the country.  The amendments were proposed by Ministry of Health and approved at the Council's meeting chaired by Sh. Mansour Bin Zayed Al Nahyan.

MSC approves plan to change medical check-up procedure for foreigners

Abu Dhabi, 6 June 2010 (WAM) - The Ministerial Service Commission (MSCMSC) held a meeting today at the Presidential Palace under the chairmanship of H.H. Sheikh Mansour bin Zayed Al Nahyan, Deputy Prime Minister & Minister of Presidential Affairs.

The MSCMSC members approved a proposal tabled by the Ministry of Health to amend categories of medical screening for foreigners who enter the country for residency, employment or education.

They also endorsed a draft federal law that aims to regulate licensing of healthcare facilities.

The MSCMSC members discussed the role of Ministry of Environment & Water in the face of climate change. The Ministry was asked to propose and implement a public policy about climate change and alternative energy.

Also approved was an amendment to federal law no. 24 for 1999 on environment protection. The members also reviewed closing accounts for a number of federal entities for the fiscal year ending on 31 December 2009.
