Assalamwalekum all
I hope you are doing well .I want to enquire about transfer process from one employer to another employer.Actually my frnd is working in company since 2.5 years and in his job contract it is mentioned that his contract will be for 1 year and after that it will be automatically renewed for every year.He has actually resigned from current company couple of days ago keeping in mind his notice period of 1 month since he got an offer from another company and to transfer his iqama to that company as it is his own transferrable iqama.But now his company is saying that he need to complete 3 years and if want to go in between then he must pay his company balance month salary as per Article 77 labour law.He will complete 3 year term in january next year so if he want to leave company in july next month den he will have to pay his company 7months salary.In his agreement ,it is mentioned that any party can terminate contract by serving notice period of 30days or immediately upon notice after payment in cash to the injured party.
Please guide abt what his employer told is correct or not.

Hi! I am facing similar issue. The contract that was uploaded by my current in Gosi has already expired last Feb 2020 and I rejected the new contract last March when private companies were required to upload their employees contract in Gosi.
My current employer claims that my paper based contract has clause saying it is automatic renewal and that it will expire in April 2023. I’d like to seek for answers, I read that old contracts- paper based are no longer valid since the implementation of the new system wherein employees needs to upload elecronic contracts in Gosi. If you have any information about this case, kindly comment. Thank you.
As long as you are receiving your salary in your account.
Your contract is running.
And gosi is THE DIGITAL CONTRACT itself.
It doesn't matter if the company has uploaded the hard copy on it or not.
And if you came here on company visa then you can't simply outrun/bypass your current employer.
That's the TRUTH.
Hi! If the gosi contract is the digital copy and it is showing expired then they cannot enforce the old paper based.

am from mawarid manpower anybody knows about this agency and kinldy let me knows people can be release from this firm, my contract had 2 years when i joined 2018 but they says its auotmatically renewed going to be expire 2022 how its possible they wasnt get any approval from me i thought the iqama only can be renewel yearly once. it is true?

Actually they can.
If you came here on their visa then they can do that.
Hi! It is stated clearly that the new unified employement contract in gosi prevails and replaces all current ageements may it be oral or written. So if you reject it, the current employer cannot enforce previous agreements.

No my friend.
It hasn't been implemented fully. If one came here on a company visa then they can enforce so many things.
This so called new system is still just a dream.
Thank for your comments brother. May I ask what is your reference is stating that this new system in not implemented and it is just a dream? Because as far as I know, the ministry of labor officially announced its implementation already last march 2021.

Nothing is implemented by just saying. They said they are going to do it.
But it is really sad and annoying that it hasn't been yet.
Hundreds of guys got final exit on their VISAS because of this hiccup.
It's like a political announcement. And remember, in practical ways they can't do this just by one click or through an announcement.
As long as companies are paying your fees or taxes they have the hold/authority over the visas.
And government is letting them to enjoy that leverage it doesn't matter we like it or not.
Their is what we call a contractual obligation, if we have dine our part as the employee. We have all the rights to fight for it. Even if they issue a final exit, it can be cancelled if a case is opened in court.
It has been done by a lot of people who fought for what they deserve. But if you do not believe in this labor reform initiative, it is up to you. And if all expats will continue to have that mindset, then the changes that we are looking for will never happen.

Yes, anyone can fight it.
But just remember, your wife and kids would wait for you for years.
Yeah, that's right.
That case can be as long as 2 or 3 years.
Not always, but it can be.
And the thing is not about the mind set, it's about the system.
And you know very well about THE SYSTEM here.

There is no other condition that can transfer you directly like this:
1. Expired iqama
2. Red nitaqat
3. No valid/existing contract
4. company released
hiiii my company already in red status this moth 25 my contract finished I try for transfer but company refused now trying get final exit even they are no any reply what should I have to do

Yes, you can.
Just tell your old employer that you need a transfer.
Then find a job and get the transfer.

Thanks for your early response, what if they issue exit is it possible to cancel it? Even if i paid 15k sar in my old employer to transfer in my current employer,also i paid half amount of my transfer before when i transfer in my current employer with amount of 3000 sar is it possible to cancel the exit visa? because i already spend almost 20k sar and they spend nothing to me when i come here because im locally Transfer,i have a new job offer now from other company.
