United Kingdom: Are there new visa rules for high-potential individuals?

Here's some good news for English football clubs. The Home Office has recently approved new visa criteria for international footballers, resulting in increased flexibility for these foreign talents. This is advantageous for football clubs as they will be able to continue recruiting internationally. Now, does the Home Office's assistance extend to other foreign talent?

Work permits in the UK: The exception for football players

This case highlights the significant influence of football, which extends well beyond the realm of sports. Since Brexit, the UK has implemented a points-based visa system. English football clubs had been facing difficulties in recruiting certain foreign talent who did not meet the new criteria. The Football Association (FA) approached the Home Office, and their request was granted. On Wednesday, June 14 (the beginning of the summer transfer window), the FA announced that the Home Secretary had approved their proposal. The new rules will apply to international players but with some exceptions.

The points-based visa system will remain in effect for the majority of international footballers. Only Premier League and Championship teams will be allowed to register a maximum of four foreign talents, while League 1 and 2 teams will be able to register two. Ultimately, the FA aims to establish an ecosystem that enables foreign talent to continue signing for English clubs while promoting domestic players. This is crucial for the FA to maintain the ability to attract the best international players.

Towards increased flexibility for high-profile expats?

Does the "football exception" also apply to other areas? Can high-potential foreigners bypass the visa requirement? The answer is no. The soccer exception remains exceptional. Nevertheless, the UK has introduced two visas to attract foreign talent.

High Potential Individual (HPI) visa

Introduced on May 30, 2022, the HPI visa is a two-year visa specifically for highly qualified foreign talent who have graduated from the world's most prestigious universities (according to rankings by the Home Office). This elite visa is also available to international entrepreneurs and creators who wish to work or establish a business in the UK. For these high-potential workers, a job offer is not required. The HPI visa allows them to come directly to the UK and work for the company of their choice. They even have the flexibility to change jobs.

Global Talent visa

The Global Talent visa is designed for high-potential foreign nationals working in three fields: digital technologies, arts and culture, or research and academic studies. The British government refers to these individuals as "leaders" or "potential leaders." There are two possible routes: the first involves applying for prior approval certifying one's status as a "leader" or "potential leader." The second option allows applicants to directly apply for a visa without needing prior approval. This route is reserved for foreign talent who have received awards in fields recognized by the British government, such as architecture, arts and culture, digital technology, industry and fashion design, film and television, or science, engineering, humanities, social sciences, and medicine.

The Global Talent visa permits individuals to stay and work in the UK for up to five years at a time. There are no limits on the overall length of stay, as the visa can be renewed for one to five years. After three to five years, depending on the sector, it is even possible to obtain "indefinite leave" and permanently immigrate to the UK.
