Visa refused, objection than appeal to court

Good day,


i am Algerian, my partner is dutch i applied to short stay visa on January 2022 to celebrate our wedding

in the Netherlands, my visa got refused within a week , we proceeded to the objection procedure through a lawyer on February 2022


1. Insufficient means for the duration of my intended stay to which I submitted my updated bank statement

2. The intention to leave the territory of the member state could not be ascertained to which I submitted work contract,

approved leave of absence from my work, salary certificate, some events and meeting i have to attend at my work.

and my social and economic ties to my country, and how i should stay with my father.

3. Sufficient justification for the purpose of stay to which I submitted several letters explaining our relationship,


after 5 months of waiting, i got a negative decision from the IND claiming the same above motives 1,2 and 3


we appealed to court, with more supportive documents we have a hearing this january 2023;

can someone please tell me what are the chances to get a positive decision,

because i am frustrated from this situation, and IND did not take in consideration my documents,

Hi and welcome to the Forum.


When regulators make such decisions it is normally because they have evidence of something that has produced the answers you have previously been given.  If they have got it wrong on a point of law, then your lawyer should be able to present this to the court and they will either agree or not.  Other than that, they will decide whether the further information you provided is in fact sufficient and then judge in your favour, if not, then your appeal will fail.
