Clarification for "Document attesting his fiscal residence"

Post new topic

Hello all,

I've been trying to find an answer to a specific question but to no avail.

I'm going to be applying for the digital nomad residence visa. The consulate here in India calls it the "DR" visa while elsewhere it's referred to as the D8 visa.

The document checklist as well as the website here mentions the term "Document attesting his fiscal residence": https://vistos.mne.gov.pt/en/national-v … tal-nomads

Can someone please clarify what this means? Does it mean proof of accommodation long enough to be a tax resident? Or does it mean a Portuguese NIF? Or does it mean a tax residency certificate of your country of tax residence?

I have tried asking the consulate but they never respond or respond with generic information.

I would be grateful if someone can help clarify what they mean by this.

Thanks,

gfahmed

It’s Portuguese NIF.

Good luck 👍

You can have this under the form of a pdf through the portaldasfinancas by searching for "certidões"

or directly with this link (of course after being logged in) and selecting "residência Fiscal" from the list

@gfahmed

Thank you for your response. I also sent you a personal message with some other questions.

My NIF currently has my Indian address on it along with details of my financial representative. I hope this is fine since obviously I cannot change the address on the NIF without first moving to Portugal.

Understood. Thank You

However, since I have not moved to Portugal yet, My tax/fiscal residence will be my current country of residence.

So I'm guessing they only want the NIF document itself?

@Zurtle,

A certificate of tax residence is a document that indicates the taxpayer's residency.

There are 2 types of Portuguese Digital Nomad Visa you can apply for:

If you want a digital nomad visa valid for up to 6 months/year*, you need a tax certificate from the country where you currently pay taxes.

If you want a digital nomad visa valid for more than 6 months/year*, you must have a Portuguese NIF and obtain that tax certificate in Portugal.

*within a tax year: eg. 2023, 2024, ...

The tax residence certificate issued through the Portal das Finanças is the only document that proves the fiscal residence in Portugal for the activation of the Convention to Avoid Double Taxation.

@JohnnyPT Thank you. I was able to get the tax domicile document from the website.

The document says I currently do not reside on Portuguese territory and lists details of my financial representative.

Hopefully, this should be enough for them along with the NIF document itself.

Thanks

@JohnnyPT Hi Johnny, if I apply to the digital nomad visa which would allow me to stay more than 6 months, do I still need to present a tax certificate at the first stage of the visa application? I believe that I should present the document which proofs my fiscal residence in my country of origin where I pay the taxes. and when I move to Portugal I should apply to get NIF document for the second stage of appliaction? is my understanding correct? Does the document attesting my fiscal residence should be translated in english? As the document from the register is in the language of my country of residence

JohnnyPT

@Camilla, Hi.

Some confusion in what you wrote. The answer is in this thread in post #6. The reason is simple. If you stay in Portugal for more than 6 months a year, you become a tax resident in Portugal for that year. So:

- you need to have a tax residence in Portugal.

- you must have a Portuguese tax number ( NIF ) and get the tax certificate that proves the taxpayer's residency in Portugal ( ... this has nothing to do with your fiscal residence in your country of origin where you use to pay taxes)

All documentation must be in Portuguese or English (I think they also accept French). If it's in another language, everything must be with a notarized translation for english.
