My experience with verification against EU law - Oct 22 - Apr 23

Post new topic

Joaquín L

Hi all! I would like to share my experience with my recent (and successful) verification against EU Law application.

For context I am from the Philippines and I met my Dutch girlfriend while I was living in Spain. They usually don’t allow Dutch nationals to apply for verification against EU Law but there is an exception if they have lived in another EU country.

So here is the timeline:

Sep 19 2022 - I arrive in Schiphol with a tourist visa (type C)

Oct 11 2022 - We sent our application to the IND, it contained the following:

1) Photos of the timeline of our relationship, luckily we have met each others parents by then so we made sure to include photos with each others families. We also included screenshots of our WhatsApp chats just to be sure.

2) Translated versions of our contracts: work and house contract for me and just work for her. (Take note we didn’t officially live together but we showed screenshots of us looking for a house, super lucky that they weren’t too strict on this!)

3) Bank statements from both of us in the last three months living in Spain.

4) Application form

5) To be sure I included a copy of my residence permit in Spain to show that I was there legally

Oct 25, 2023

Received the letter from the IND allowing me to work and a few days after a letter asking me to pay the fee.

—— I received nothing for the next months ——

April 11, 2023 - Called the IND to extend my sticker since this was the deadline, got an appointment the next day.

I don’t know if it helped but I tried speaking in Dutch each time I called in case they took that into account.

April 12, 2023 - Extended my sticker and was given a month.

April 17, 2023 - Received an email from the IND, they’re giving me a residence permit! I was coincidentally on a date with my girlfriend when this happened :)

April 19, 2023 - Received a letter saying my card was ready for pickup!

April 24, 2023 - Successfully picked it up in the IND branch, you have to book an appointment for this

That’s basically it, we were never called nor interviewed by the IND.

If you have questions or need help, feel free to contact me, I’d be so glad to help! I know the uncertainty can be grueling but het komt wel goed!

@Joaquín L 2) Translated versions of our contracts: work and house contract for me and just work for her. (Take note we didn’t officially live together but we showed screenshots of us looking for a house, super lucky that they weren’t too strict on this!)

What exactly do you mean with screenshot of you looking for a house, because my partner will not be able to be on the rental contract due to his residence status. So I don't know how to prove it.

I sent our screenshots of texts with potential landlords, just to show that we really were looking but just couldn’t find a private place in Spain :)

@Joaquín L Thanks. But were you able to register at the same address whilst applying?

Joaquín L

@britishgerman2023 Hi! Yes I was! It's required to do that to get the BSN
