WELFARE: NEED CLARIFICATION ON MY EP CANCELLATION

KINDLY READ MY MESSAGE AND PROVIDE YOUR VALUABLE SUGGESTIONS. Please explain me how to get rid of it and how to proceed further on the company who cheated me.


MY EP WILL BE EXPIRE IN MAY 2024.


I have worked in Malaysia for 4 months and my company in Malaysia deducted taxable amount every month about 30% of of my salary.


Due to my Mother's Severe health issues, I requested my company for WFH option for a month. I left the country by giving notice and reached India to take care of my dependents.


Once I reached India, HR asked me to submit timesheets etc., and I supported them though I was in tense situation about my mother's health. Once, everything received from my side they sent an immediate termination letter to my email and now the company HR threatening me that going to be police case and consequently going to blocklist my passport.


I responded to their email in below passion:-


I have not resigned at all and ran away to India and still I communicated in regular intervals that I will come and work once my dependents get set. But, still you decided to terminate me without discussing it with me.


I have not resigned on my own by breaking the contract. You stick to your decision to terminate me on an immediate basis.

Hence, requesting you to cancel the EP and provide NOC documents at the earliest.


For Timesheets filling and all contacted me in regular intervals, How can you terminate me without giving any warning letters/emails by sending termination email without discussing with me though Clause 7 mentioned in offer?


Not only in my case, if the same situation arises in any one of your dependents who are staying  far from you, If any employee or his/her dependents are NO MORE or CRITICAL SITUATION, an employee needs to wait for prior approval from the employer? If I want to run away, why would I return assets in the client location?


FAMILY FIRST REST NEXT IN HUMAN BEING's LIFE THOUGH I WAITED FOR EMERGENCY REQUEST ON SAME DAY. WHAT YOU WILL DO IF SOMETHING GOES WRONG IN THE SAME SITUATION?


Note:- Reiterating again my valuable points.


I never came across this situation in my entire professional life that I am unprofessional, dishonored, breach ect., and smoothly released from esteemed organizations where I worked in India without a remark. My abroad dreams are shattered because I trusted you though it is contract and I still believe on my ability


1. Without informing is considered as absconding, without approval is not considered as absconding. You have not approved my emergency request on an urgent basis on humanitarian grounds.


2. I was not informed about the furlough period (No work No pay ) for 1 month before coming to the Malaysia induction session. If I could have known the same from my well-wishers in India, I would have rejected your offer before putting papers in my previous organization. But, still I agreed and obeyed the same though I was informed about this at the last minute.


3. I came to Malaysia by leaving my earlier comfortable permanent employment, good life in India and joined with you believing in your words, promises. Before accepting the offer , they clearly told me that we have 4, 5 clients we are dealing with and that you can continue with the company for a longer period in Malaysia. The same has been conveyed in Orientation sessions and other interaction calls through only WHATSAPP.


4. I have not violated  any contract, because any employee or his family members has the right to be hospitalized, if he is medically unfit to work depending on his health or his dependents health condition. No company has the right to STOP an employee, if he or his dependents are medically unwell.


5. As there is no provision to carry company assets along with me without approvals from those who are working abroad before leaving to native country. So, I handed over the company assets within the company premises only i.e., the safest place only at Reception and clearly mentioned that it has been handed over to IT-Team. Same has been conveyed to the respective manager. It's purely not my fault.


6. I am a well being person both personally and professionally, served many clients with a healthy manner, on-time deliveries with quality code deliverables etc. . I am not the person that has tarnished and affected our relationship and reputation with one of our long-term clients, leaving to your .


REQUESTED COMPANY LIKE BELOW:


Once again requesting you to cancel the EP with immediate effect and provide an NOC document at the earliest.

I don't have any plans to work in any consultancy organizations anymore, even in INDIA or ABROAD by seeing your reply.

It is never right to terminate someone without fair justification and thorough investigation. Employer needs to conduct investigation, demand explanation from employee and proceed to domestic inquiry if required. Then only, the termination can take place.


But then again, if you decided to tender your notice, you are not supposed to leave the country till the EP cancellation is complete. You may actually get blacklisted because of this.

@7ee How can they blacklist me? I have valid proofs with me. They're not responding to my emails and even calls as well after continuous follow ups.


Also, I didn't get your last Para. Please explain
