Hello Everyone,

My wife (dependent) who has not been able to find a position yet needs to renew her ID. We were never told to join integration as she came just before the integration course became mandatory.

Now, when inquired with the commune about the requirements of renewal of her residence card (A), they have also asked to provide integration proof.

How can integration efforts be proved to the commune/immigration? if this was also your case, what did you submit which was accepted as proof?

I look forward to your help and suggestions.

That is new for me too since I thought  the integration course is only necessary when you are going to apply for the citizenship but for a renewal of A card is weird for them to ask. Perhaps try seeking an advice from an immigration lawyer about this because integration course needs atleast 6 months and considering they dont really offer any classes during summer break you might have to wait till September.

@umairsaeed01 Apparently, It is the rule. Not just for newcomers dependants but also who have been living here before 2022. For which, the commune never bothered to tell us that for renewal, you need some sort of proof. Now, very close to expiry of the card and upon inquiry, they have put up this requirement and shared with me this information from IBZ:

If anybody have more information how to deal with this situation or which proof can be submitted, I will really appreciate it. Thanks

If you are on single permit the your spouse don't need to prove integration for renewal see the exceptions.

On the other hand, the obligation does not apply to the following requests:

requests for international protection;

requests for authorization or admission to residence submitted by a foreigner recognized as stateless by the competent Belgian authorities;

requests submitted on the basis of the following articles of the law of December 15, 1980:

article 10, § 1, 4° to 6° provided that they are members of the family of a foreigner recognized as a refugee or beneficiary of subsidiary protection or recognized as stateless by the competent Belgian authorities;

article 10, § 1, 7°;

article 19, § 2, paragraph 2;

article 40;

article 40bis;

article 40ter provided that they are family members of a Belgian who has exercised their right to free movement, in accordance with the Treaty on European Union and the Treaty on the Functioning of the European Union;

article 58;

articles 61/2 to 61/4;

article 61/7;

@hssn601 Yes, I understand that for application of Long stay visa by dependents of single permit holders, there is no requirement. But, I am talking about renewal of residence card A while being in Belgium

As per this link people who came on article 10bis are exempted from integration.

From what I understand your suggestion is wrong.

The commune doesnt have to guide you to take the integration course. It is your due diligence to find out the law of the country and follow it.

@ARMaliq

You need to register yourself with the Agency of civic integration.

https://www.integratie-inburgering.be/e … d-brussels

Once you have registered for a course, you can communicate with the commune that you have alredy registered for the course and it will be completed in the due time.

In my case, even though my wife couldnt complete the dutch classes, her permit was renewed since she already took the social integration classes.

ARMaliq

@arjunprasad2143 Thanks for the straight forward answer. We will do that. May I aks how much was/is the permit duration of the new permit issued to your wife?

@ARMaliq Hi, I need some insights regarding work Permit renewal.   My employer has applied for renewal last month and today i received MOE approval. And the mail says - I should wait for Annex 46 to apply for Residence permit Renewal.

from your experience how much time it takes to get Annex 46?

also can i start RP renewal for my spouse ?

My commune is Ixelles.

ARMaliq

@MRamkumar Depends on the backlog for immigration. and time of approval of work permit. Join the other thread where people are sharing the timeline of SP approval.

I don't think so that renewing your RP would trigger change in the Residence permit of your spouse unless her expiry is also approaching. In that case, check with the commune what could be the next step for your spouse.

I am not suggesting anything just writing the rule if one need integration or not.

arjunprasad2143

@ARMaliq

Same as mine. 3 years extension.

arjunprasad2143

@MRamkumar

You can continue working with your new work permit.

You just have to wait for the annex 46. If in the mean time if your RP has expired, the commune will provide you with an annex 19 which will be valid till you get your residence permit approved.

As for your wife, her renewal can only be done once your residence permit is approved.

MRamkumar

@arjunprasad2143 Hey Arjun! Need you kind assistance.

For Dependent RP renewal,  I recently enquired an agency linked to my employer. And i got below response

  • Past 6 Salary Slips
  • Lease Registration proof
  • Proof of integration course
  • Health insurance for whole family
  • Attestation from Public Centre of Social Help - that we never asked help from them
  • Copy of Police Clearance Certificate

The last 2 points in red were my queries. Any idea where we can gather these? What documents/proofs were requested in your case ?

@MRamkumar

Hi,

My husband was asked some time ago to bring an attestation that he had not received social assistance. We got it from CPAS. They have offices in different communes. You can read about them.

https://www.belgium.be/fr/famille/aide_sociale/cpas

For the police clearance, you can get it from the commune. In Schaerbeek commune, we download it online. I don't know about your commune but you can go to their website and see if you can download it.

masstonsils0e

@MRamkumar You should send an email to Ixelles (etrangers@ixelles.brussels) with your questions. They usually respond within 2 business days.  The police record is something that the Ixelles commune can get themselves, or you can go to MonDossier and get it online (you will need your ID and a card reader)  For the other document, your partner will have to go to an office that provides a certification

that you haven’t received welfare.  Ixelles can give you info about the address of that agency
