Work as consultant for US company on Spouse visa

Hello everyone, I am moving in with my spouse who is on Highly skilled migrant visa working in the Netherlands. I have the work permit which states "work freely permitted". My current employer in the US wants to hire me as a consultant. I am trying to consult with attorneys and tax advisors in the Netherlands to figure out if working remote is possible. But I wanted to reach out and see if anyone has worked as a consultant for an US/foreign company or if it's even possible to work as a consultant while residing in Netherlands with my visa status. Would appreciate any advice. Thanks!

Hi- thanks for your question. There's a number of threads on the site about people working in the Netherlands as a consultant for a company outside the Netherlands, so I'd recommend reading through those threads.


According to IND, if your spouse is here on a highly skilled migrant visa you are also free to work. Working for someone in another country then likely is not prohibited under that visa status, but you almost certainly would be considered a tax resident in the Netherlands and (if you are a US citizen) would need to file/pay taxes in both countries (there's lots of methods to avoid double-taxation, but it's still a lot of paperwork).


This isn't legal advice, I'd certainly recommend contacting IND or various immigration/tax professionals to get clarification.
