Partner Visa - UK to Netherlands

Hi all,


I've reached out to a couple of Law firms and the IND, yet in the mean time I wanted to see if anyone has any advice or has been in a similar situation.


My British partner and I (Dutch) are unmarried, but in a long-term relationship of 4+ years and currently live together in England. We hope to be able to settle together in the Netherlands early next year. Now this is not a problem for me, but my partner will of course have to apply for a visa. We would like to do this via a partner visa.


I will therefore first move back to the Netherlands later this year and register and settle again, so that my partner can submit the application at my home address. However, there are a number of things that we initially encounter with regard to a partner visa.


I work in England as a self-employed person for an American company. So I am a freelancer and am registered here with a Tax number, but I did not have to set up my own company for this. Because I only have 1 client with a fixed salary every month and make no profit/loss and have no expenses, I am not an entrepreneur for the tax authorities in the Netherlands. I am also not employed. You could see that in practice I am employed, but with a freelance contract. This is 'fake self-employment' in the Netherlands, so I do not want to register as an entrepreneur because I do not have the ambition for multiple clients.


I have been working for this client for 2 years this coming November and will continue to work for at least another year after this, they also said that they're willing to put 2 years on my contract, if that helps the process. I earn 2,500 GBP (2,900 EUR) gross every month, so  this should meet the income requirements for both self-employed and employed... but I don't know what I need to meet due to my situation in the paragraph above. I find myself a bit in a grey area where the IND has not had a specific answer for me so far.


I think it's important that I can proof that my income is stable, which it is, I just wonder how I can do this best..


Again, I've reached out to a lawfirm already, so this is just to see if anyone has been in a similar situation.

Hi- thanks for your message. It doesn't sound like anyone else has immediate insight into your sitation and it definitely seems like the IND has some pretty specific standards for income requirements when sponsoring a partner (see this link if you haven't seen it), so you should definitely talk to a lawyer or possibly just ask the IND for more guidance as to what they are looking for.
