I resigned for the company by terminating qiwa contract with 30days notice period.

But company didn't accept resignation my last day of notice period is 29/2/2024, but until now I'm working for company but from march to May company didn't pay me salary so I requested new contract from another company after completing 3 month.

I accepted qiwa contract but in the status showing that pending notice period 90 days to transfer.

Please can someone suggest me what to do.

@om269895

I've oined company n January 2023 and they sent me qiwa contract in July 2023, so as per my joining 1 year will complete in January 2024, as per this I resigned n January 2024 but company didn't accept. So I terminated qiwa on February 2024 with 30 days notice period. After this I continued y work for 3 month so company idn't pay me salary for this 3 month so now my Iqama will get easily ransfer if company didn't ay 3 month salary?

So I request new offer from another company and I accepted their qiwa contract also. After accepting it is showing pending notice period of 90 day's to transfer.

Now the question is can join this new company before this 90 day's end or not?

I have applied for termination of my contract in QIWA and the last day is 30/06/2024. I have completed 22 months in this company. When I contacted the QIWA, they said once the termination is done in QIWA, I should be able to accept the new contract from another employer and transfer will be done immediately. But, as I read more and more similar issues, I too have concerns if my transfer will happen or not and will have to wait for three months without salary....

dear Expat.com team.

We would be very grateful if you can help us to find a suitable consultant in this matter which is a very common but problematic issue for many professional expats in KSA.

May Almighty help us all.

It'll ransfer immediately but there are conditions:

1. Direct Transfer

Direct Transfer doesn’t require the current employer’s approval or waiting until the employee’s notice period is completed.

You can apply for Direct Transfer when:

  1. The employee’s work permit is expired and has not been renewed by their current employer, or
  2. The employee’s Iqama is expired and has not been renewed by their current employer, or
  3. The employee didn’t get a work permit issued by their current employer for more than 90 days since their arrival in the Kingdom of Saudi Arabia.

If any of these conditions are met, you will be able to onboard your new employee to the establishment as soon as you complete the transfer process. To complete it, go to your Establishment fund in the Ministry of Interior account.

2. Transfer pending notice period 90 days

This transfer path requires the employee to complete their notice period at their current establishment before transferring to your establishment.

You can apply for it:

  1. when employee has been in Saudi Arabia for more than one year, and
  2. depending on the plan of the Ministry of Authentication the contracts.

3. Transfer pending for current employer approval

This transfer path requires the current employer’s approval.

You can apply for it:

  1. when the employee has been in Saudi Arabia for less than one year, or
  2. depending on the plan of the Ministry of Authentication the contracts.

@Beerappa k

Dear My case is like this. I have applied to terminate the contract in QIWA and ending date is 30/06/2024. My question is, can i accept a new contract soon after the termination is complete (i.e - 01/07/2024) and start work with my new employer.

best regards.

Currently are you with company visa or Own visa?

If company visa then you can accept new contract but your company has to agree to transfer your iqama. If they are ready then you can start work with new company mmediately after accepting qiwa.

If your company is not ready to transfer your iqama then you'll ave to face some difficulties to get it transferred.

If you are on own visa then there is no problem at all you can accept new offer and start working.

My new employer uploaded the Qiwa contract within my current 60-day notice period which is ending on June 30. However, Qiwa is showing a 90-day pending notice. My new employer is advising me to request that my old employer update the notice period completion date to June 30 before accepting the transfer, which they claim will resolve the 90-day notice issue. Is this accurate?

@Beerappa k,  regarding the 90-day notice period pending, my notice period is 60 days until June 60. my new employer uploaded Qiwa within the last 14 days of the 60 days and is advising me to request that my old employer update the notice period completion date to June 30 before accepting the transfer, which they claim will resolve the 90-day notice issue. Is this accurate?
