TAPU Non-Issuance

Bought off plan apartment from Suryapi in Antalya. The apartment was delivered to me last May. Waiting for TAPU for more than a year. Is this normal?

@hameed1239 No in my view it is not normal, did you take a recognized realtor?

Thanks for your comments. Suryapi is one of the big project developers in Turkey. My apartment is in Kepez, where there is a big urban renewal project under construction. The strange thing is that phase where my apartment is located people are residing and have all the utilities in their name. I  am also paying monthly aidat.  I live in Istanbul where electricity connection without TAPU is not possible. Suryapi excuse for not issuing TAPU is that they are waiting for ISKAN. In my opinion, at a minimum, they can issue kat Irtifaki. 


If I want I can rent my apartment but I'm scared the tenant will not leave. I am at present trying to sell the apartment through Devir Temlik contract. Basically, you assign your apartment to the prospective buyer.  I think I will talk to a lawyer also.  I suspect that Suryapi might have used the apartments as collateral for bank loans.

Maybe I'm asking a dumb question but has the apartment been paid off in full?  I'm not familiar with procedures in Turkey but here in the US the deed is not transferred to the owner until the lien is paid in full.  Otherwise, you definitely should seek consultation with an attorney.

The apartment is fully paid off and was delivered to me last year. Thanks for your suggestion. I will be seeking legal advice.

@hameed1239 no it is not…if you dont have the Tapu then you dont own the property. i bought three apartments in 2020 off-plans, the contractor/builder took the money and sold them to someone else, three years now with the court trying to get my money back with zero results. I hope all goes well with you.

@hanialturk73 Exactly why I did not go for off-plan (lawyers, fights, ...), just resale  (not too old of course). We bought end of 2021 (just in time before the excessive boom and Ikamet restrictions).
