Annex 15 and expired residence permit

Post new topic

dambada

Hello everyone;

My husband came to Belgium at the beginning of this year with a family visa. I am a student and my husband needs to renew his resident card depending on me. In September 24, we applied for a extension of residence card that will expire on October 30, but we also applied for an annex 15 to be guaranteed. Last week they asked us for additional documents and we sent them the next day, but we still haven't received an e-mail for neither the annex 15 nor the extension of the residence permit. My husband's residence card expires in 9 days. Has anyone encountered such a situation or has any information?

Thanks in advance

Normally annex 15 automatically given while you do an extension of your or your dependant resident card.

However if validity of card still available authority might be postpone it.

I recommend go to municipality this days with your  application form and ask an annex.

This happened to me but there is nothing to be worried , even my card totally expired and no annex issued (due to backlog) my next card was valid from the end date of previous card.

It happened to me as well: residence card was about to be expired and no annex 15 either. Called city hall, they said "The annex 15 will be issued only after your card expires". I asked " But that's a gap in between! What if I got a police check in between?" They almost laughed and told me " Nothing to worry about. The police will understand."

Maybe OP would try his/her chance with another medewerker one more time and explain with a calm and gentle way.

On one hand they are right because as soon as police enter your NRN to system  they can see that you are waitin for a new card. But on the other hand you are right because you should proove that you are legal. (Normally its annex 49 for you 15 for dependant) Some medewerkers  knows this rule and or some doesnt.

In my case i explained the lady gently why i need that paper and she asked from her superiors to issue one.

However this annex doesnt provide you travel flexibility in EU. Its just extension of your legal stay.
