Unusual Tenant's Legal Rights

If you are an owner or a tenant, here are a couple of things you may not be aware of here in Brazil:


1/ If a property is rented, and the owner wants to sell it, the tenant has the first right of refusal to buy. In other words the owner must offer to sell to the sitting tenant before seeking another buyer - by law. Of course the owner can always wait until the rental contract is over, then sell freely.


2/ If an owner wants to inspect or enter a property that is rented, he must - by law - give at least 7 days notice to the tenant, the tenant must agree, and the tenant must be present when the owner visits. An owner cannot enter a rented property without meeting these conditions, as, under Brazilian law, a rented property is the possession of the tenant, and to do so would be illegal...
