Immigration Amendment Act? - LPP Netherlands - South Africa

Hallo everyone, :)

I have read different stories on this forum about the immigration amendment act having changed in June 2011.

And my first question concerning the Life Partner Permit was the following;

- Before it was possible to apply for the LPP whilst in South Africa on a tourist visum, what changes have the immigration amendment act brought to this since June 2011, or is it still a possibility to apply for the LPP from within SA on a tourist visa?

My story is that I am currently living and working in the Netherlands and my boyfriend currently resides and works in South Africa. I am quitting my job at the end of this year so I can be with him next year. My parents used to live in SA and I was able to obtain a permit through them, they however do not reside in SA anymore and are both Dutch (meaning I have to find another way). My boyfriend and I have stayed together for longer periods of time both in South Africa and the Netherlands but we have no proof of co-habitation or shared financial responsabilities yet.

- Thus, I would be able to get the police clearence and medical reports from within the Netherlands
- But I would need to go to SA to get a shared address and open a shared bank account together with my boyfriend in South Africa.

So I hope I can apply for the LPP without having to return to the Netherlands again.
Does anyone have good experience with this? or any advice?

According to the South African embassy in the Netherlands here, you need an official co-habitation agreement, signed together with a notary. (This was the key thing needed to even get the LPP forms from them, so I have not received them yet if I could do the application here). I'm guessing my boyfriend and I need to be in the same country to do this (co-habitation/shared financial responsabilities) eventhough he is going to find a place for us or that we can try and do things at a distance?

P.s. does anyone know how difficult it is to open a bank account in South Africa as a foreigner without a permit?

I am not too sure about the holiday/LPP visa story, I applied for my LPP while I still had my student visa. 

However there was a big emphasise on the shared habitation, so I think that is going to be a big problem for you to get a LPP without those documents.  Don’t worry too much about the shared financial responsibility (shared bank account) you must just show them that you both got funds/income.

You need a police clearance for every country you have lived in since your 18th  (it took me 10 weeks to get the one from S.A.)

Your medical certificate can be from Holland or S.A. it must just not be older than 3 months. (It is properly cheapest to get it in S.A. I paid less than R1000 for my TB x-rays and  the medical certificate)

Regarding opening a bank account, you are only able to open a bank account when you have a visa, and a proof of address in S.A.

What are you planning to do in S.A.??? I am asking because maybe the LPP is not the best visa for you to apply for..

If you are going to work then maybe rather apply for a work permit and then apply for the LPP later. There are companies that will sponsor your work permit if you have needed skills. There are call centres always looking for Dutch speakers, look for positions on Gumtree.

If you have funds to support yourself (or your BF supports you) maybe you should apply for a study visa, take a year at uni or something. Get some cohabitation under your belt before applying for the LPP.
You can also apply for a volunteer visa, you will just need a organization that will support your application, that will give you something to do here as well, getting to know people.

Hi Lindsey

You must make sure that you can apply for the LPP while on a holiday visa, I am not sure if you are still allowed to do that.

Also I applied for my LPP in September and I am still waiting, calling Home Affaires every week, but I am just being told that it is still being processed, I am now going to initiate an investigation into why it is taking so long, and mean while I am not allowed to work, to be honest I am considering cancelling my application and go to DK and apply from there.

So if I was you, I would try my very best to get the visa before coming here.

Lindsey, what I know you're NOT allowed to work while waiting for your permit to be processed. That's the stupidity of this situation. In theory they must issue a permit within 30 days after they accepted your application. So I guess that's the reason the law forbids you to work till you get your permit. But in reality it takes up to 6 months for it to be issued. And the law doesnt take it into account.
So there're two options: 1) you work illegally (of course if you can persuade your employer since they risk to pay a fine); 2) you lose your job offer... But who cares...

Honestly I'd love to know other people's experience. How do they handle this situation?
