CAN FOREIGNERS WORK IN MALAYSIA WHILE HOLDING A MARRIAGE VISA

I would like to employ a Vietnamese who is holding a marriage visa. Does my compamy to apply a WP for her. Is there any levy to be paid annually and how much is the levy? What procedure is there to follow?

You are going to have to do all the paperwork and sponsor her WP.

Go to Immi...they will walk you through the process.  If you get all the paperwork done correctly, they should approve it fairly quickly, as well.

What I want know is whether I need to pay for the levy?

yes you have to pay for the levy that is for professional work permit is 1950Rm and for service sector is 490 and for plantation sector is 360Rm accordingly

Why do I still need to pay for the levy since she is already married to a malaysian? I thought levy is only for those holding work permit in malaysia. She is currently applying for a marriage visa to stay in malaysia.

She can't work on a marriage visa.  She would be working on the work permit you are sponsoring.

Her marriage visa allows her to stay in the country, but not work as a foreign, non-resident of Malaysia.

That's why you need to sponsor her work permit.

What does marriage visa mean?

If she is married to a Malaysian she DOES NOT need a wp. She can earn any salary and all she needs to do is take her contract and social visit visa (marriage) to immigration for it to be stamped that she can work with you. This costs you nothing!

That is the law although I know people are told different things. Spouses of malaysians are no longer dealt with by the employment pass section(since 2010)

you have to apply for a "chop" on the visa for "right to work". It is a rubber stamp but you will need the required documents. Letter of employment offer and company licenses+ any service bond from guarantor.

they each have to apply for a student visa the their institution of choice. Their visa has nothing to do with yours.

you will also need a copy of a valid company license within 6-months of expire.
