Study or Spousal Visa?

Hi,

I'm a Brazilian citizen currently living (legally) in the U.S. I got married to my South African spouse recently but we had been in a registered domestic partnership since March, 2011.

I want to move to SA in 2014 to further my studies and probably to stay there for a while (5+ years). My spouse would only move to SA the following year (2015).

I'm aiming on obtaining permanent residency eventually. I was wondering what would be the best route to follow: secure my study visa at the SA Consulate in the US and then (fiver years later) request my permanent residency in SA? Or request a Spousal/LPP visa (temporary residency) from the start?

Thank you,

Marcelo

Hi,
I would apply for a study visa, I have applied and obtained both, and study visa was way easier to get. Also I don’t think you would be able to get an LPP if your partner does not live in S.A. If you contact the S.A. consulate they should be able to provide you with requirements for both visas.
Good luck with it.

Regards Sarah
