Hi Josaphine,

Your input is much appreciated. If the records on the database are "swept" after a few years it certainly will make things easier on Edward.

His situation however is a bit different since he is already married to a Brazilian citizen. If he is able to obtain a Tourist Visa he theoretically can stay forever, even if he wasn't issued a Permanent Visa, since by our laws he is categorazed as "inexpulsável" he can't be expelled from the country unless he were to divorce or separate. Also he could even go higher than immigrations and apply to the Regional Federal Court for Permanency via Judicial. In this case he would most likely be granted permanency by the court as a matter of routine. Bit more work and effort on his part, but in the end I'm sure he'd be OK.

Today i went to the travel agent to ask my tourist visa requirements. When he saw my passport he told me that you need to give brief explanation about your permanent visa why you are not using ? Definitely you need to get Invitation application from your wife. Also you need to explain why do not you apply for Permanent visa. So i do not know what to do now ? If i get invitation letter from my sister in law from sao paulo definitely embassy will ask me. Why do not you get invitation letter from your wife ? Because my old permanent visa is stamped in my passport. Please help me..... What kind of explanation i need to give to embassy.

I'm kind of confused Eduard. What Permanent Visa are you talking about? Did you already obtain a VIPER Permanent Visa for Brazil in the past? If so, why didn't you use it when you obtained it?

If you already had a VIPER how long ago did you receive it and have you ever entered Brazil since it was issued? These are all important questions, since if it was issued less than a year ago it will still be valid. If it was issued and you did come to Brazil following that and have now been out of Brazil less than 2 years it will also still be valid. If it's over a year old or you've been out of the country for more than two years, there is still a chance you can ask for your permanent status to be reinstated at the Consulado-Geral do Brasil. You should check with them.

It really looks like you're going to have real problems given the circumstances you have described. Clearly a new passport won't be any different from the old one, it will show the deportation and will lead to the Brazilian Consulate or Federal Police asking for a PCC from the UAE, which will probably make it impossible for you to obtain another Permanent Visa now. Sorry to say it's starting to look like your situation is hopeless.

You know we already discuss about my matter in few months before. You also suggest me come by tourist visa and apply permanent visa here. Because you know we are already discussed this matter with josephine and Dhiraj. I already get permanent visa from Embassy of Brazil in Abudhbi but that time i am in some problem in UAE charged some misdemeanor case against me. I already explained my position to you. You also suggest me that permanent visa is expired if you are not use within 90 days. but that permanent visa is issued September 2012. So its not valid anymore you already told me. Now i need to come by tourist visa. So travel agency asked me you need to give brief explanation about why you are not using permanent visa ?

As far as I am aware, depending on the country of issue, one should enter Brazil within a year or two years of issue a Permanent Visa remains valid. If you were to enter Brazil this month there is no question that it is valid. After September,  it may not be. You should check with the Consulate regarding that. However, you can still request that it be revalidated.

No, if you didn't enter Brazil within the 90 days then you need to start the process all over again. They're pretty strict about that.

I never entered Brazil one time also after issued my permanent Visa from Embassy of BRazil in UAE. BUt in my Permanent visa clearly mentioned i need to entered within 90 days. Otherwise i need to start all process again. I am also confused now. Please tell me my visa is still valid. Can i book flight tickets.

My suggestion would be to look for some immigration lawyer there or make your wife look here. Or go to Embassy there and try to talk out the possibilities.Please make sure that you talk with some officer there in Embassy.

Edward, if you're late and didn't make the 90 days, just go to the PF. You will be fined but they will register the visa.

Actually my Permanent visa issued from UAE. But i got deportation from UAE so i can not go there again. Now i am in India. So i told my wife and myself sent a mail to embassy in UAE. Whether the visa is valid or not? Please help me. So can i come with that old visa issued on 17.September 2012. If you help me i never forget in my life dhiraj.

If you did never pick up your visa in the first place you will need to reapply.

Since you have picked up the visa, but didn't use it you should be able to have it re-activated. You may be subject to a fine for not using it, but it shouldn't be a big problem. Contact your nearest Consulado-Geral do Brasil and ask how to procede.

To reactivate your visa, you should come to brazil and register with the federal police, you will have to pay a fine of R$ 165.00 if memory serves me right for not having registered in 90 days.

Be aware, your visa expires on September 17th 2014 is you do not enter Brazil before that date.

Hi,

I am an Indian and am going to apply for permanencia in Sao Paulo based on my marriage with my Brazilian partner. I was issued PCC on 15th June 2013 and I am planning to apply for permanencia in 1st week of November. My PCC is valid for six months however, I was told that the PCC should not be older than 3 months at the time of applying permanencia. Now I will be in Brazil by next week and dont have time to apply for new PCC and by the time I would apply for permanencia my current PCC would be 3 months and 10 days old. How can I get a new PCC while I am in Brazil? Please suggest.

Your PCC must have been "legalized" by the Consulado-Geral do Brasil in India no later than 90 days from its issue. If it hasn't been legalized then take it to the Consulado and get that done immediately or you're going to need to obtain a new one and have it legalized. If it has been legalized by the Consulado then it doesn't matter how old it is. The clock stops once it's legalized.

One more query. If suppose for some reason, this PCC is not valid, can I obtain a PCC while being in Brazil? I read that Indian consulate in Brazil does issue PCC, I am not sure if they would legalize it as well.

I can't speak for the policies and procedures for the Federal Police in India and laws regarding issuance of the police clearance while abroad but I do know you can have your documents legalized by the consulate serving your area while abroad. It obviously will be VERY time consuming (mostly waiting for the documents to arrive and be returned) it will also be quite a bit more expensive with mailing costs.

If you do mail it off use a certified method (trackable).

For example - if I was to lose my birth certificate while in Brazil I would need a new, certified copy from the vital records department in the county I was born in. They would mail it to me in Brazil and then in return I would mail it to the Brazilian Consulate in Chicago for legalization. After which they will mail it back (at my expense of course).

I hope this helps. But I would start this process ASAP instead of waiting to the last moment. Especially if you are already in Brazil.

According to all of the information on the Federal Police website, the criminal record check must be issued by the main police authority in your country of origin. Then it must be legalized by the Consulado-Geral do Brasil in your country. Even if you can get the PCC issued here in Brazil by the Indian Consulate, it will still have to go back to the Consulate in India for legalization.

i applied it from the embassy in Jordan in 31-7-2013 and there is no respond till now . is that normal ?
how it usually takes to issue the visa ?

Hello Starm,

Generally the process takes around 3 to 6 months if all the documents are in order, so you should be hearing new in the next month or so. Don't worry, you have absolutely no idea how much longer people wait when they apply here in Brazil. It can take years here.

You have already waited almost 3 months. I wouldn't cancel it - I do not know if you even can cancel it. Do not pressure the consulate though. Remember you are at their mercy.
