A Bulgarian lady living legally in the UK wants her daughter and two
children to come and live in London. The problem is her ex husband who
has visitation rights with the children thinks they are just going for
a holiday. He signed a document, witnessed in a police station, allowing
the children to cross borders. Can he have this document rescinded by
the courts within a short time. If so how can the mother combat this.

Can anybody tell me how she should proceed with the whole deal.

Hi racer,

I suggest you to visit the Lawyers in London section, and to get in touch with the lawyers, who will be able to guide you through this case. ;)

Regards,

David.

I work with children who have been through emotional traumas. I suggest your daughter thinks very carefully about this. Unless there is a very compelling reason for the children to be kept away from their Father, it would be a seriously damaging thing to do to them.
also, I have the feeling that due to the number of cases like this laws were changed to stop parents taking children away from their parents

She should respect the rights of her children to maintain a relationship with their father, even if she has no respect for his feelings.

She could also find out about the Hague Convention (perhaps contact an organisation called Reunite). Britain has signed the Convention and acts upon its obligations: the Convention states that in cases of international child abduction, the state to which the children have been taken will return them to the state they came from and the courts there will determine where the children would live. The bottom line: if this lady's daughter took the action that she contemplates, the British authorities would step in and return the children to Bulgaria.
