If a Chinese citizen has given up his Chinese citizenship and has become portugal citizen can his brother sister apply for PR or citizenship or portugal on basis or his her brothers portugal citizenship ?

According to the provisions of Lei n.º 37/81 de 3 de Outubro, Lei da Nacionalidade (Portuguesa) only the children of Portuguese citizen (mother or father) born in national territory, or abroad; or a child adopted by a Portuguese parent, are considered Portuguese by origin.

In all other cases (such as siblings of a naturalized citizen) they would first need to obtain permanent residency, then apply for naturalization after the applicable waiting period (6 to 10 years depending on their country of origin). They would also need to meet all the other requirements for naturalization such as having a clear criminal background, ability to read, write and speak Portuguese, etc.

So the short answer to your question is NO, not only by virtue of being the sibling of a naturalized Portuguese citizen. There would first need to be some other fact that would entitle the individual to permanency in the country, such as marriage to a Portuguese citizen for example, then followed up later by an application for naturalization.

In fact, being the sibling of a naturalized Portuguese citizen does not in and of itself, even impart any rights to apply for permanent residency. For more information regarding the requirements for permanent residency in Portugal, you should visit the website or contact the Consulado-Geral do Portugal in your country of origin.

Cheers,
James
