Question on getting workers without permit & apply for EP

Hi guys, I have 2 questions to ask on behalf my company :

1. wanted to hire an vietnam guy as construction worker, this guy stay in Malaysia for sometimes, he only came with passport, no permit no other documents. What is the procedure we should do?

2. wanted to hire few workers from other company as construction workers as well, they said their existing company permit is going to expired soon (I guess is Employee Pass instead of permit), what should I do here? Get an EP for them? What is the procedure of apply for EP? and any other details?

Sorry yea, this is the first time my company wanna to hire foreign worker, so all this procedure is new for me.

1. There was a Rehiring programme carried out recently which finished at the end of last year. A similar process needs to be done for the Vietnamese guy.  It is to regularise workers without employment passes or expired passes. Not sure what is the current position.

2. The other guys you want to hire (as long as they have current EPs) can be done through http://www.fwcms.com.my/

There is a maximum age (45) and length of working in Malaysia.

@gravita, for the fwcms website you sent, I can apply new EP for them there? Are they need to cancel the current Ep before I apply?

Yes only one EP can be valid at any time. But the current employer needs to do the cancellation. It's part of the agreement to release their workers.

The "cancellation" is actually the shortening of the term of the current EP. This is done to coincide with the start date of the new EP. A word of advice - have a look at the passports of the people you want to hire, to check out things like (a) expiry date of the passport (as this can cause complications) and (b) the current EP details. Take nothing as given when dealing with immigration.
