Only registered Malaysian companies can apply for EPs and ESD are asking for details of incorporation which has been verified via the link given, and then all the documents need uploading into the system for scrutiny. The list of documents is found in this guide: https://esd.imi.gov.my/portal/pdf/TC-ES … r-2017.pdf

Among the criteria for hiring foreigners is the Paid Up Capital is sufficient. It is not possible to hire anyone for a shelf company - it needs the appropriate capital injection. (and of course public access premises etc.)

The EP category (I, II, or III) is related to the salary for the position (see guide). Salaries depend mainly on industry sector and it sounds like they are also asking for justification for Category III EPs i.e. salaries under RM5k per month

Quote from booklet linked above:

EXEMPTION FROM MINIMUM SALARY REQUIREMENT OF RM5,000 FOR
EMPLOYMENT PASS CATEGORY III APPLICATIONS

1. Companies that intend to apply for Employment Pass Category III is required obtain approval from the Ministry of Home Affairs (MOHA) to seek exemption from the minimum salary requirement of RM5,000.
2. This is compulsory for companies that fall under unregulated sectors or Regulatory Bodies, which is not in the purview of any Approving Agencies.
3. The application for exemption from the minimum salary requirement of RM5,000 can be done through the ESD online by selecting the function for EP-III status under Setting.

End of quotation:

You can check typical salaries by looking at Jobstreet and reading the above booklet guide carefully should solve your issues. The info needs to be very precise and accurate plus realistic.

Do remember also that income tax will be legally payable according to the salary earned whilst holding an EP.

Also any person for whom you are applying for their first EP needs to be outside Malaysia.

Hi,
Can you tell me what is a justification letter to support the application to work on the 6 month social pass. Does the company’s HR write it or myself?

Thanks,
Kerry
