My friend currently working in a company in Oman from December 2017. He has been not getting his salary for three months.so he wants to cancel his contract and return india.but his company asking for an amount for cancellation. Is that legal as per Oman labor law?. does he has to pay that sum of money?

Hi skkollannur,

Your friend's company has not paid him for 3 months ... that is in itself is a labour violation. Your friend must report his company immediately to the Ministry of Manpower and to the Indian Embassy for quick redressal.

And, no, there is no fee to be paid for by the employee for getting the employment visa cancelled. But if the employee is quitting for personal reasons, then the employer would expect that their investments made in terms of time, effort and money be compensated to a certain extent. Though this is not in the law, it is done by most SMEs.
