Cannot aply New EP Stage one without NOC frm existing employer

Post new topic

Hi all,

Need advise on the case below :

Currently with Employer1 (Indian MNC), want to join Employer2 ( Malaysian company), On notice period (left 45 days left).

EP with employer1 is valid for longer duration than my Last work day (currently in notice period)
so EP need to be cancelled so that employer2 can apply fresh/New EP for dates after Last work Date.

In addition to this, to serve the last 30 days of notice period ( mandatory), have to travel back to India(base location) for which Employer1 EP to be cancelled (in next 15 days).

Furthermore, Employer 1 not ready to give any NOC due to which Employer 2 is not able to apply Stage 1
of New EP as post 2017 the NOC submission rules have been changed and NOC needs to be submitted
with Stage 1 rather than Stage 2 ( as earlier).

Now, how to get the New EP applied with Employer2 without NOC, last 45 days left for the Notice period and have to travel back to India also in 15 days for serving the rest 30 days.

Please suggest any possibilities for timely New EP application as need to join the new employer
as soon the current notice period is over.

The EP application can only be applied for after the current EP validity expires i.e. you have no immigration status in Malaysia. Assume your salary is over RM5000  otherwise you will also have a 3 month cooling off period.
