Expatriate Application Rejected by ESD

Hello @Gravitas,

Recently my EP application got rejected by ESD due to the reason "Skillset can be found locally".

But for the same skillset, the MDEC has approved to my friend a few months ago from different MSC status company which has paid-up capital pretty low than my company.

So, I want to know what is the difference between MSC status and Non-MSC status companies, why they rejected my application and how can we justify through appeal?

I'm not sure your analysis is behind the rejection as all companies need to apply for an expatriate quota of positions. I am therefore wondering if the issue is there are too many foreign employees compared to local employees which would result in immigration basically stating a local can do the job. 

The next step is to Appeal and new information has to be presented as to why you have skills that are not available among the Malaysian workforce. There could be something "wrong" with the job description the company is using, so analyse whether it describes required skills and duties correctly. You could compare it to what your friend works against.

However, the new government has a policy to prioritize local labour so the seemingly illogical decision could be based on a newer, more recent policy. Particular focus is on middle management positions which now should go to Malalysians.

There are some sectors that are just not open to foreigners e.g. accountants and legal positions

Yes, My position is not under those sectors.

Apparently, MSC status companies are easily able to get approved for the same position.

Most of the MSC status companies in KL are having expats like me with the same skillsets which I have. (Source: LinkedIn)

Meaning that the ESD is giving more advantage/priority to ICT companies (MSC status companies) through MDEC?  :|

I have applied for a job and the company selected me for Arabic position. However, the company applied for ES but they got rejected! Is it because of the current situation? And how long it will take to appeal the application. I'm living in Malaysia.
