Help Brother in Jail in Cambodia

Hello my brother was arrested on Monday on false allegations. Anyone who knows him knows that he did not do what they are alleging.  We are looking for anyone who knows information about the jails there and possibly would be willing to visit him so we can know what is going on.  This whole situation is scary.  Please anyone help our family. The embassy says there are no phones to call us.  We are clueless as to what is happening to him or his arrest.  We might eventually need to pay someone to bring him food or money.  We know the jails are deplorable there.  We need to know he is ok.  Please anyone out there willing to help ease our hearts and minds some. Message me

Fred

Perhaps posters in Cambodia could comment on the legal and safety issues, if any, of getting involved in this.

Chericline

What legal issues would there be?  I’m not asking anyone to get involved in anything other than info about the jails and maybe going to see him to see if he is ok

Fred

That would depend on the situation in general and how the police view your brother. If it's just a money scam, that'll get sorted with greenbacks sooner or later.
This needs comments from people in the country in order to get a better picture of what the situation is if you get involved with anything the cops are up to.

I gather the cops are willing to arrest foreigners for a variety of reasons, recent cases including pornographic dancing by a bunch of Brits, NZ and Canadians, and an American man arrested last week for child sex crimes (Some odd photos of him with kids on the net that look wrong in some ways, but the cops have them and will probably use them as evidence).

Aside from the obvious lack of worry the police have when it comes to arresting foreigners for whatever reason, I gather the police are poorly paid so there seems to be a general requirement to pay for anything you need from them, and access to a prisoner might well be expensive. If the prisoner is accused of something serious, that might well create problems for an expat (or local) that request visits as they might be assumed to be associated with him, thus associated with any crimes the police claim he committed, regardless of the truth behind the accusations.

What we need here is local knowledge before anyone gets involved and potentially put themselves in a difficult situation.

I would invite local posters to comment on any potential issues so less experienced people don't walk into something that will give them a headache.

Good luck my hearts with you .

Mr_Dome

I hope it'll all work out for you. Some good general info for those in the country already, wishing to visit someone who's incarcerated:

And prisoner's rights in English:

Chericline

Thank you so much. This was very helpful

What are the charges?

Chericline

Chile molestation. It’s false charges

I thought this was the case as the only US guy arrested was this guy charged with multiple sexual assault of 3 underage girls in Siem reap.

I don't know why you are so sure it's false charges, you haven't been there right?

I would wait till the court comes out with a verdict.

As the procedure is he is now in detention at the provincial prison, awaiting trial.

The US embassy could have sent someone over to visit him.

Although the "rights" posters are from the United Nations, you'll find that $$$ is required to see a person in jail and if money is not paid, things may be made more difficult.

My (Khmer) wife told me, when I suggested it would be good to visit some ex-pats in jail in Camboida and offer some books to read and keep their minds occupied, that it was difficult without money changing hands.

Fred

4 girls.

Questions

Is it normal for young girls to have tattoos?
Is it normal for young girls to be allowed out to very dodgy areas on their own?
Is it possible the father saw a tourist, send the girls to him begging, then accused him of having sex?

I've been taking a look at this but I have no way to know whether he bedded them or not, but the arrest looks like a set up for cash.

I've been reading more about it too.

Where did you read the girls have tattoos?

If they were begging he would have given them small money, not $120. He admitted to giving them money, for what?

Pub street is not a "very dodgy" area, it's a tourist street with partly some bars.

The charges are what they are, the court will have a verdict soon.

Btw I know that Aple is infamous for "creating" victim statements, like it could be that the other 2 girls are in such an entrapment. Just offer the families the compensation money of more than $1000 and they will force their daughter to make a victim statement. It has happened before, but I must admit that there was always already a case of victims, just the number got enlarged.

If this happened in Pub street there will clearly be CCTV footage of the guy meeting the girls and taking them somewhere. Pub street is full with CCTV cameras.

Let's hope the truth will prevail.

Joe

Fred

Take a look at e photos of the girls - one has tattoos on her arms

The video will be the killer evidence either way. if he didn't take them, he's probably innocent.
If he did, there goes a sad end to life as he knows it.

Agree with you Fred.

And being a lawyer, if he took the girls (they say for the second year) he made a hell of a mistake.

Joe

PS Where did you see photos? Both newspapers only show a photo of him.

Fred

I'll send you a PM later as posting the link will give the gentleman'a name away and that might be seen as unfair as there's a lot of people on the net assuming guilt.

This blokes no stranger to Mug Shots either.    “Media reports”  indicate he was suspected on previous occasions of similar activities.

Doesn’t look good does it.

Paying your way out will be expensive.  A Chinese tourist got arrested recently at PP airport bringing in $855,000 in cash without a suitable explanation of its origin.

If he offered an unofficial “fee” to clear the matter ,,it obviously wasn’t enough😆

PM me the link, please.
I know about the drugs thing a long time ago, but no previous history of messing with kids

Chericline

Media reports are lies.  He has never been in Cambodia in 2018. Don’t believe everything you read

Chericline

He had never been here in 2018. That’s a lie. Don’t believe all the media reports.  They were trying to extort money out of him at the police station

Chericline

Ok how do we get access to videos on pub street ?

Chericline

He has no mug shots other than getting arrested with a weed pipe like 20+ years ago

Chericline

I know they are false charges. My brother isn’t a child molester

Chericline

Yes Fred they took him to western union day 1 and tried to get him to drain his bank accounts.  Total extortion

JoeKhmer

Leave it up to the provincial court.

If they are in the possession of CCTV footage it will be simple: either he met and took the girls or he is innocent.

david cooke

A man is innocent until proven guilty, it's dangerous to speculate on a case  knows anything about, yes and of course people get arrested and falsely charged all the time, that's a hard fact, video evidence is often not conclusive proof of identity often due to poor image quality and therefore not admissible in a court of law, this topic started by the brother of a man arrested asking for some humanity.

Chericline

The courts and police are corrupt.  They aren’t going to go out of their way to provide video footage to say he is innocent

JoeKhmer

At least I mentioned in my post that he was charged with child abuse.  That means the same as you say,  he is innocent until proven guilty by a court.

He is in pretrial detention and the provincial court will come up with a verdict.

Until then nobody knows the truth,  except the accused.

david cooke

Thank you

Chericline

No here you are guilty until proven innocent.  There is no speedy trial. The people who investigate are the prosecutor and the Judge   You typically don’t get bail.  The system is nothing like a fair system in the United States.  The prisons are deplorable

david cooke

You need to get on a flight and go and see him and try to use this site to find a lawyer.

The accused is a lawyer himself!

The US embassy should have sent someone to visit him.

Chericline

I’m in Cambodia. Does anyone know of any criminal attorneys that speak English

Chericline

They sent the fbi to read him his rights.  They only go out one time per month

david cooke

Hi Joe, this gets worse the accused is a lawyer, I guess the lawyer needs a lawyer, cheers Dave.

Fred

I've been reading this story in newspapers and on a variety of forums, most posters on the latter assuming guilt.
I would prefer posters here keep an open mind, or at least not make wild accusations without proof.

Thanks to Joe for the CCTV comment - that's probably the single most useful post of the thread regarding likely evidence.
