Regarding 182 days for resident status

Hi Gravitas,

I have started working in KL from May 2017.  I have never been charged 28 % tax.  I had some medical issue, so i worked from India from Oct'18 to March'19 (Work from home). I joined back in Mar'19 and  resigned and move out from KL on 18 June'19.  I joined new company on 30 July'19. They started deducting 28% tax.  So till today date i am in KL and and never move out from KL during this time. 30 Jan'20 i completed my 182 days if you count from 30 July'19 .

1. So from Feb'20 my salary should be deducted by 28 % ?
2. Shall i get my refund when i fill return in April'20 for 2019.
3. Can i now go to india for more than 14 days.

They say if you have to be tax resident you should stay at-least 182 days. Is that 182 days needs to be continuous i mean 14 days rule implies.

Have you have any further information on it ?

I am also in kind of situation where I will be coming to KL for some period of time may be a month and then want to go back to india for 1 week or 2 week (if Tax rules are ok) and then come back again in KL.

Do I need to stay 182 days continuous at one go ? or does it needs to be 182 days in one financial year ?
