Landlord making false claims!!

Hi everyone!

Quick back story: I was living in Bavaro for 3 years, returned to Puerto Plata in May 2020. I rented an apartment that ended up having many issues, the worst of which (for me) being rats. I moved with my 2 children at the end of September, handing the keys back during the checkout on 29th. On 4th October I get a message from the owner's representative accusing me of damaging the floor tiles, and threatening to take me to court.

Now during my 4 months there I reported every fault, repair need etc. to the owner. I had no real furniture because I was saving (literally only a small fridge and a washing machine; my children and I have been on air mattresses) Because I have not stayed for the year as the contract states, I have also forfeited my deposit. I do have some pictures that show the damage to the tiles before I moved in.

I've been told by a few people not to worry and that it won't get to the court stage, and I have also been advised by others to get a lawyer!? My question is whether anyone has been through anything similar? How did it pan out? I'm incredibly stressed with it hanging over my head but also frustrated as I know it is just their way of trying to get more money out of me, so I will fight if needs be.

Are the pictures of the damaged tiles date stamped?    Send them to the landlord as proof they were already damaged.
I'd guess that will be the end of it.

And if it isn't you will go to mediation first so likely you can resolve.

Always take pictures make a list and sign off with the landlord when you rent a place!

Hello!

Thank you so much for your message. The photo's are not date stamped but the information (date and time) can be accessed via the phone they were taken on. I did send one photo (didn't want to send all of my evidence) to the representative, but he was still adamant that he was going to get a "3rd party involved" so still waiting.

I have taken photos at the new apartment just in case I will forward these to the property manager as proof/ a makeshift inventory.
